             8      General Description:
             9          This bill amends the Medical Assistance Act in the Utah Health Code.
             10      Highlighted Provisions:
             11          This bill:
             12          .    prohibits the Department of Health from imposing a Medicaid eligibility resource
             13      test for certain pregnant or postpartum women.
             14      Monies Appropriated in this Bill:
             15          None

             20          26-18-3.2, Utah Code Annotated 1953

             22      Be it enacted by the Legislature of the state of Utah:
             23          Section 1. Section 26-18-3.2 is enacted to read:
             24          26-18-3.2. Medicaid -- Pregnant women.
             25          Beginning July 1, 2005, for purposes of determining eligibility for the Medicaid
             26      program, the department may not impose a resource test for a pregnant or postpartum woman:
             27          (1) described under 42 U.S.C. 1396a(l)(1)(A);



             28          (2) whose family income does not exceed 133% of the federal poverty guideline; and
             29          (3) who is not otherwise eligible for the program.
