             7      LONG TITLE
             8      General Description:
             9          This concurrent resolution of the Legislature and the Governor gives approval for the
             10      construction and operation of a Class V commercial landfill to receive
             11      asbestos-contaminated waste. The landfill is to be known as the Contract
             12      Environmental Services Asbestos Landfill and is to be operated by Contract
             13      Environmental Services, Inc.
             14      Highlighted Provisions:
             15          This resolution:
             16          .    provides that the landfill is to be located 19 miles north of Aneth, in San Juan
             17      County, Utah;
             18          .    provides that the proposed landfill is to accept asbestos-contaminated waste as a
             19      Class V landfill; and
             20          .    provides that the landfill permit was approved by the Department of Environmental
             21      Quality on February 16, 2005, and will become effective March 1 of this year.
             22      Special Clauses:
             23          None

             25      Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
             26          WHEREAS, Contract Environmental Services, Inc. desires to operate a Class V
             27      commercial landfill to receive asbestos-contaminated waste for treatment, storage, or disposal;


             28          WHEREAS, the site of the proposed landfill is located 19 miles north of Aneth, in San
             29      Juan County, Utah;
             30          WHEREAS, the site of the proposed landfill is a parcel of approximately 80 acres,
             31      located in Township 39 South, Range 26 East, Section 18;
             32          WHEREAS, Section 19-6-108 of the Utah Code requires that the applicant for authority
             33      to operate a commercial landfill must receive approval from the local government;
             34          WHEREAS, Section 19-6-108 of the Utah Code also requires that an applicant for
             35      authority to operate a commercial landfill receive approval from the Utah State Legislature and
             36      the Governor of Utah as a part of the approval process;
             37          WHEREAS, Section 19-6-108 also requires that an applicant for authority to construct
             38      and operate a commercial landfill receive approval from the executive secretary of the Solid
             39      and Hazardous Waste Control Board within the Department of Environmental Quality prior to
             40      receiving legislative and gubernatorial approval and this approval was granted on February 16,
             41      2005; and
             42          WHEREAS, the permit for the Contract Environmental Services Asbestos Landfill will
             43      take effect on March 1, 2005:
             44          NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
             45      therein, that Contract Environmental Services, Inc., is granted approval by the Legislature and
             46      the Governor to construct and operate a Class V commercial landfill to receive
             47      asbestos-contaminated waste at the specified site to the north of Aneth in San Juan County,
             48      State of Utah.
