A list of visitors and a copy of handouts are filed with the committee minutes.

Committee Chair Scott K. Jenkins called the meeting to order at 2:15 p.m., and announced
that S.B. 38 and S.B. 96 will be heard in another meeting.

1.    S.B. 21 Limitation on Liability Regarding Liquified Petroleum Gas (D. Eastman)

    Sen. Eastman presented the bill and the following amendments were distributed:

    1.     Page 2, Lines 36 through 40 :    

             36          (2) There is a rebuttable presumption that a seller, supplier, installer, handler, or
             37      transporter of liquified petroleum gas and the necessary equipment and appliances have
             38      followed all applicable standards and procedures established by the
{   fire code   }        Liquified Petroleum Gas Board       adopted in

             39      accordance with
{   Section 53-7-106 by the Utah Fire Prevention Board pursuant to Section

             40      53-7-204  
}
  the provisions of Title 53, Chapter 7, Part 3, Liquified Petroleum Gas Act       .



    MOTION: Sen. Davis moved to adopt the amendments.

    The motion passed unanimously with Sen. Mayne absent fo the vote.

    Sen. Eastman explained the bill assisted by K.S. Cornaby, Attorney, Rocky Mountain          Propane Association.

    John Hill, Utah Petroleum Marketers Association, spoke in support of the bill.

    Charles Thronson, Attorney, Utah Trial Lawyers Assoc., expressed concerns with the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably as amended.

    The motion passed unanimously with Sen. Mayne absent for the vote.

2.    S.B. 103 Liens on Aircraft (T. Hatch)

    
Sen. Hatch explained the bill and answered questions from the committee.

     MOTION: Sen. Hatch moved to pass the bill out favorably.

    The motion passed unanimously.

3.    S.B. 32 Limitation of Landowner Liability for Public Recreation (G. Bell)

    
Sen. Bell explained the bill and answered questions.

    Sue Player, UTA Analyst, further clarified the bill.

    Charles Thronson, Attorney, Utah Trial Lawyers Association, spoke in support of the bill.

     MOTION: Sen. Hellewell moved to pass the bill out favorably.

    The motion passed unanimously.

     MOTION: Sen. Killpack moved to adjourn.
