APPROVAL OF MINUTES:
MOTION: Sen. Mansell moved to approve the minutes of February 1, 2005.
The motion passed unanimously with Sen. Dmitrich and Sen. Thomas absent for the vote.
1. H.B. 55 DRUG OFFENSE PENALTY ENHANCEMENTS (Rep. B. Dee)
Rep. Dee presented the bill to the committee.
MOTION: Sen. Arent moved to pass H. B. 55, as amended, out of committee with a favorable recommendation.
The motion passed with Sen. Dmitrich and Sen. Thomas absent for the vote.
2. 1ST S.B. 177 INCREASE STATUTE OF LIMITATIONS ON RAPE (Sen. E. Mayne)
Sen. Mayne presented the bill to the committee.
Jennifer Boone, victim; Erika Thorn, Utah Rape Crises Center; and Ron Gordon, Utah Sentencing Commission, spoke in favor of the bill.
MOTION: Sen. Mansell moved to pass 1st. Sub. S.B. 177 out of committee with a favorable recommendation.
The motion passed unanimously with Sen. Dmitrich absent for the vote.
3. S.B. 181 CRIMINAL CODE AMENDMENTS ( Sen. Karen Hale)
Sen. Hale presented the bill to the committee.
Mark Shurtliff, Utah State Attorney General; Sonia James, Citizen; Ken Wallentine, Utah Law Enforcement Legislative Committee; Sylvia Haro, Utah Republican Hispanic Association;
Paul Boyden, Statewide Prosecutors; and Ron Gordon, Utah Sentencing Commission, spoke in favor of the bill.
Gayle Ruzika, Utah Eagle Forum; Sandra Rodrigues, Citizen; Jonas Filho, Citizen; Maryann Christensen, Utah Eagle Forum, and Jonas Rodrigues, Citizen, spoke in opposition to the bill.
MOTION: Sen. Arent moved to pass S.B. 181 out of committee with a favorable recommendation.
The motion failed with Sen. Mansell, Sen. Buttars, Sen. Thomas, and Sen. Madsen voting against.
MOTION: Sen. Mansell moved to adjourn.
The motion passed unanimously.
Sen. Buttars adjourned the meeting at 10:05 a.m.
