Chairman Bramble called the meeting to order at 8:15 a.m.

Sen. Greg Bell assumed the chair.
         
1.     S.B. 24 WASTE AMENDMENT (Sen. Curtis Bramble)

    
Sen. Bramble presented the bill to the committee.

    Bill Sinclair, Utah Department Environmental Quality and Lowell Peterson, Clean Harbors     spoke to the bill.
    
     MOTION: Sen. Bramble moved to pass S. B. 24 out of committee with a favorable
    recommendation.

    The motion passed with Sen. Stephenson absent at the time of the vote.

2.     S.B. 36 SALES AND USE TAXATION OF PAWN TRANSACTIONS (Sen. R. Allen)
    


    
Sen. Allen presented the bill to the committee.

    MOTION:
Sen. Allen moved to amend S. B. 36 as follows:

1.    Page 1, Lines 8 through 15 :    

             8      General Description:
             9          This bill amends the Sales and Use Tax Act to address the taxation of
  redemptions or repurchases of property as part of a       pawn

             10     
{   transactions   }        transaction       .

             11      Highlighted Provisions:
             12          This bill:
             13          .    provides definitions;
             14          .    provides a sales and use tax exemption for
  redemptions or repurchases of property as part of a       pawn      {   transactions   }        transaction       ; and

             15          .    makes technical changes.

2.    Page 43, Lines 1304 through 1307 :    

             1304          (64)
{   sales   }        redemptions or repurchases       of property      {   redeemed or repurchased   } by a person if that property was:

             1305          (a) delivered to a pawnbroker as part of a pawn transaction; and
             1306          (b) redeemed or repurchased within the time period established in a written agreement
             1307      between the person and the pawnbroker for redeeming or repurchasing the property.
    
    The motion passed with Sen. Stephenson and Sen. Bramble absent at the time of the vote.

    Rob Jolley, Utah Collateral Lending Association and Andrew Stephenson, Utah Taxpayers     Association spoke to the bill.

MOTION: Sen. Allen moved to pass S. B. 36, as amended, out of committee with a     favorable recommendation.     
    The motion passed with Sen. Stephenson and Sen. Bramble absent at the time     at the time of the vote.
    
     MOTION: Sen. Allen moved to adjourn.

    


    The motion passed unanimously with Sen. Stephenson and Sen Bramble     absent at the time.

     MOTION: Sen. Allen moved to adjourn at 8:45 a.m
