8 General Description:
9 This bill reauthorizes certain state entities and programs that would otherwise sunset
10 before the 2007 Annual General Session of the Utah Legislature.
11 Highlighted Provisions:
12 This bill:
13 . reauthorizes certain named state entities and programs that are scheduled to sunset
14 before the 2007 Annual General Session; and
15 . makes technical changes.

32 Be it enacted by the Legislature of the state of Utah:
33 Section 1. Section 63-55-209 is amended to read:
34 63-55-209. Repeal dates, Title 9.
35 (1) Title 9, Chapter 1, Part 8, Commission on National and Community Service Act, is
36 repealed July 1, 2014.
37 (2) Title 9, Chapter 2, Part 4, Enterprise Zone Act, is repealed July 1, 2008.
38 (3) (a) Title 9, Chapter 2, Part 16, Recycling Market Development Zone Act, is
39 repealed July 1, 2010.
40 (b) Sections 59-7-610 and 59-10-108.7 , regarding tax credits for certain persons in
41 recycling market development zones, are repealed for taxable years beginning on or after
42 January 1, 2011.
43 (c) Notwithstanding Subsection (3)(b), a person may not claim a tax credit under
44 Section 59-7-610 or 59-10-108.7 :
45 (i) for the purchase price of machinery or equipment described in Section 59-7-610 or
46 59-10-108.7 if the machinery or equipment is purchased on or after July 1, 2010; or
47 (ii) for an expenditure described in Subsection 59-7-610 (1)(b) or 59-10-108.7 (1)(b), if
48 the expenditure is made on or after July 1, 2010.
49 (d) Notwithstanding Subsections (3)(b) and (c), a person may carry forward a tax credit
50 in accordance with Section 59-7-610 or 59-10-108.7 if:
51 (i) the person is entitled to a tax credit under Section 59-7-610 or 59-10-108.7 ; and
52 (ii) (A) for the purchase price of machinery or equipment described in Section
53 59-7-610 or 59-10-108.7 , the machinery or equipment is purchased on or before June 30, 2010;
54 or
55 (B) for an expenditure described in Subsection 59-7-610 (1)(b) or 59-10-108.7 (1)(b),
56 the expenditure is made on or before June 30, 2010.
57 (4) Title 9, Chapter 2, Part 19, Utah Venture Capital Enhancement Act, is repealed July
58 1, 2008.
59 (5) Title 9, Chapter 3, Part 3, Heber Valley Historic Railroad Authority, is repealed
60 July 1, 2009.
61 (6) Title 9, Chapter 4, Part 9, Utah Housing Corporation Act, is repealed July 1, [

63 Section 2. Section 63-55-213 is amended to read:

70 (3) Title 19, Chapter 4, Safe Drinking Water Act, is repealed July 1, 2009.
71 (4) Title 19, Chapter 5, Water Quality Act, is repealed July 1, 2009.
72 (5) Title 19, Chapter 6, Part 1, Solid and Hazardous Waste Act, is repealed July 1,
73 2009.
74 (6) Title 19, Chapter 6, Part 3, Hazardous Substances Mitigation Act, is repealed July
