             9      LONG TITLE
             10      General Description:
             11          This joint resolution allows a bill to be returned to a house when it was transmitted by
             12      mistake.
             13      Highlighted Provisions:
             14          This resolution:
             15          .    allows a house having possession of a bill to return the bill to the other house
             16      without a vote when the bill was transmitted by mistake; and
             17          .    makes technical corrections.
             18      Special Clauses:
             19          This resolution provides an immediate effective date.

             22          JR-4.35

             24      Be it resolved by the Legislature of the state of Utah:
             25          Section 1. JR-4.35 is amended to read:
             26           JR-4.35. Possession of a Bill.
             27          (1) A bill is in the possession of a house when it has been receipted. [After that time,]


             28          (2) (a) Except as provided in Subsection (2)(b), after a bill has been receipted, it may
             29      be given to the other house only upon written request of that house and the concurring vote of a
             30      majority of the house having possession.
             31          (b) If a bill leaves a house after it has been reconsidered, circled, and asked to be held,
             32      and it is, through a mistake made by the Chief Clerk, Secretary, or the Clerk's or Secretary's
             33      administrative staff, sent to the opposite house, the opposite house shall return the bill to the
             34      first house upon request.
             35          Section 2. Effective date.
             36          This resolution takes effect upon approval by a constitutional majority vote of all
             37      members of the Senate and House of Representatives.
