             8      General Description:
             9          This bill amends the Criminal Code regarding the offense of homicide by assault.
             10      Highlighted Provisions:
             11          This bill:
             12          .    designates the offense of homicide by assault as "Malik's Law" after Malik Smith,
             13      who died as a victim of an assault while visiting Utah in 1989.
             14      Monies Appropriated in this Bill:
             15          None
             16      Other Special Clauses:
             17          None
             18      Utah Code Sections Affected:
             19      AMENDS:
             20          76-5-209, as enacted by Chapter 291, Laws of Utah 1995

             22      Be it enacted by the Legislature of the state of Utah:
             23          Section 1. Section 76-5-209 is amended to read:
             24           76-5-209. Homicide by assault -- Malik's Law -- Penalty.
             25          (1) A person commits homicide by assault if, under circumstances not amounting to
             26      aggravated murder, murder, or manslaughter, a person causes the death of another while
             27      intentionally or knowingly attempting, with unlawful force or violence, to do bodily injury to



             28      another.
             29          (2) Homicide by assault is a third degree felony.
             30          (3) Homicide by assault is also known as Malik's Law.
