10 General Description:
11 This bill amends Title 11, Cities, Counties, and Local Taxing Units, to prohibit a local
12 entity from imposing a fee on foster homes for the use of emergency services that is not
13 commensurate with the fees imposed on others.
14 Highlighted Provisions:
15 This bill:
16 . defines terms; and
17 . prohibits a local entity from imposing a fee on foster homes for emergency services,
18 unless the fee is imposed, at the same rate, on homes that are not foster homes.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 11-42-101 is enacted to read:

32 11-42-101. Title.
33 This chapter is known as "Emergency Services Provided by a Local Entity."
34 Section 2. Section 11-42-102 is enacted to read:
35 11-42-102. Definitions.
36 As used in this chapter:
37 (1) "Emergency Services" means:
38 (a) fire protection services;
39 (b) police protection services;
40 (c) ambulance or paramedic services;
41 (d) 911 emergency telephone service, as defined in Section 69-2-2 ; or
42 (e) E-911 emergency telephone service.
43 (2) "Fee" means a fee, fine, or charge.
44 (3) "Local entity" means:
45 (a) an interlocal entity created under Title 11, Chapter 13, Interlocal Cooperation Act;
46 (b) a special district, as defined in Section 17A-1-101 ;
47 (c) a municipality, as defined in Section 10-1-104 ;
48 (d) a county, as defined in Section 17-50-101 ; or
49 (e) a local district, as defined in Section 17B-2-101 .
50 Section 3. Section 11-42-103 is enacted to read:
51 11-42-103. Prohibition relating to fees on foster homes for the provision of
52 emergency services.
53 A local entity may not impose a fee upon a foster home or foster parent for the use of
54 emergency services, unless a person, or home of a person, who is not a foster parent is subject
55 to the same fee at the same rate.
