9 General Description:
10 This bill requires the Department of Health to provide financial assistance for room and
11 board to Medicaid clients participating in a new home and community-based services
12 long-term care program.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 26-18-404 is enacted to read:

30 26-18-404. Home and community-based long-term care -- Room and board
31 assistance.
32 If the department receives approval from the Centers for Medicare and Medicaid
33 Services within the U.S. Department of Health and Human Services to replace the Medicaid
34 program's current FlexCare program with a new program to provide long-term care services in
35 home and community-based settings rather than institutions, the department shall assist in the
36 payment of room and board costs for any person in the new program without sufficient income
37 to fully pay those costs.
38 Section 2. Appropriation.
39 There is appropriated from the General Fund for fiscal year 2007-08 only, $214,000 to
40 the Division of Health Care Financing within the Department of Health to defray room and
41 board costs for persons participating in a home and community-based long-term care program
42 approved by the Centers for Medicare and Medicaid Services on or after January 1, 2007.
