             7      LONG TITLE
             8      General Description:
             9          This bill reauthorizes certain state entities and programs that would otherwise sunset
             10      before the 2008 Annual General Session of the Utah Legislature.
             11      Highlighted Provisions:
             12          This bill:
             13          .    reauthorizes certain named state entities and programs that are scheduled to sunset
             14      before the 2008 Annual General Session; and
             15          .    makes technical changes.

             35      Be it enacted by the Legislature of the state of Utah:
             36          Section 1. Section 63-55-213 is amended to read:
             37           63-55-213. Repeal dates, Title 13.
             38          Title 13, Chapter 16, Motor Fuel Marketing Act, is repealed July 1, [2007] 2012.
             39          Section 2. Section 63-55-231 is amended to read:
             40           63-55-231. Repeal dates, Title 31A.
             41          (1) Section 31A-2-208.5 , Comparison tables, is repealed July 1, 2010.
             42          (2) Section 31A-2-217 , Coordination with other states, is repealed July 1, 2013.
             43          (3) Section 31A-22-315 , Motor vehicle insurance reporting -- Penalty, is repealed July
             44      1, 2010.
             45          (4) Section 31A-22-625 , Catastrophic coverage of mental health conditions, is repealed
             46      July 1, 2011.
             47          [(5) Title 31A, Chapter 31, Insurance Fraud Act, is repealed July 1, 2007.]
             48          Section 3. Section 63-55-235 is amended to read:
             49           63-55-235. Repeal dates, Title 35A.
             50          (1) Title 35A, Utah Workforce Services Code, is repealed July 1, 2015.
             51          (2) Section 35A-3-114 , the Displaced Homemaker Program, together with the
             52      provision for funding that program contained in Subsection 17-16-21 (2)(b), is repealed July 1,
             53      [2007] 2012.
             54          Section 4. Section 63-55-236 is amended to read:
             55           63-55-236. Repeal dates, Title 36.
             56          Sections 36-26-101 through 36-26-104 are repealed December 31, [2007] 2017.
             57          Section 5. Section 63-55-258 is amended to read:
             58           63-55-258. Repeal dates, Title 58.


             59          (1) Title 58, Chapter 9, Funeral Services Licensing Act, is repealed July 1, 2008.
             60          (2) Title 58, Chapter 13, Health Care Providers Immunity from Liability Act, is
             61      repealed July 1, 2016.
             62          (3) Title 58, Chapter 15, Health Facility Administrator Act, is repealed July 1, 2015.
             63          (4) Title 58, Chapter 20a, Environmental Health Scientist Act, is repealed July 1, 2013.
             64          (5) Title 58, Chapter 40, Recreational Therapy Practice Act, is repealed July 1, 2013.
             65          (6) Title 58, Chapter 41, Speech-language Pathology and Audiology Licensing Act, is
             66      repealed July 1, 2009.
             67          (7) Title 58, Chapter 42a, Occupational Therapy Practice Act, is repealed July 1, 2015.
             68          (8) Title 58, Chapter 46a, Hearing Instrument Specialist Licensing Act, is repealed July
             69      1, 2013.
             70          (9) Title 58, Chapter 47b, Massage Therapy Practice Act, is repealed July 1, 2014.
             71          (10) Title 58, Chapter 49, Dietitian Certification Act, is repealed July 1, 2015.
             72          [(11) Title 58, Chapter 59, Professional Employer Organization Registration Act, is
             73      repealed July 1, 2007.]
             74          [(12)] (11) Title 58, Chapter 72, Acupuncture Licensing Act, is repealed July 1, [2007]
             75      2017.
             76          Section 6. Section 63-55-259 is amended to read:
             77           63-55-259. Repeal dates, Title 59.
             78          (1) Title 59, Chapter 1, Part 12, Legislative Intent, is repealed July 1, 2006.
             79          (2) Section 59-9-102.5 is repealed December 31, 2010.
             80          [(3) Section 59-10-530.5 , Homeless Trust Account, is repealed July 1, 2007.]
             81          Section 7. Section 63-55-263 is amended to read:
             82           63-55-263. Repeal dates, Titles 63 to 63E.
             83          (1) Title 63, Chapter 25a, Part 3, Sentencing Commission, is repealed January 1, 2012.
             84          (2) The Crime Victims' Reparations Board, created in Section 63-25a-404 , is repealed
             85      July 1, [2007] 2017.
             86          (3) The Resource Development Coordinating Committee, created in Section
             87      63-38d-501 , is repealed July 1, 2015.
             88          (4) Title 63, Chapter 38f, Part 4, Enterprise Zone Act, is repealed July 1, 2008.
             89          (5) (a) Title 63, Chapter 38f, Part 11, Recycling Market Development Zone Act, is


             90      repealed July 1, 2010.
             91          (b) Sections 59-7-610 and 59-10-1007 regarding tax credits for certain persons in
             92      recycling market development zones, are repealed for taxable years beginning on or after
             93      January 1, 2011.
             94          (c) Notwithstanding Subsection (5)(b), a person may not claim a tax credit under
             95      Section 59-7-610 or 59-10-1007 :
             96          (i) for the purchase price of machinery or equipment described in Section 59-7-610 or
             97      59-10-1007 , if the machinery or equipment is purchased on or after July 1, 2010; or
             98          (ii) for an expenditure described in Subsection 59-7-610 (1)(b) or 59-10-1007 (1)(b), if
             99      the expenditure is made on or after July 1, 2010.
             100          (d) Notwithstanding Subsections (5)(b) and (c), a person may carry forward a tax credit
             101      in accordance with Section 59-7-610 or 59-10-1007 if:
             102          (i) the person is entitled to a tax credit under Section 59-7-610 or 59-10-1007 ; and
             103          (ii) (A) for the purchase price of machinery or equipment described in Section
             104      59-7-610 or 59-10-1007 , the machinery or equipment is purchased on or before June 30, 2010;
             105      or
             106          (B) for an expenditure described in Subsection 59-7-610 (1)(b) or 59-10-1007 (1)(b), the
             107      expenditure is made on or before June 30, 2010.
             108          (6) Title 63, Chapter 47, Utah Commission for Women and Families, is repealed July
             109      1, 2011.
             110          (7) Title 63, Chapter 75, Families, Agencies, and Communities Together for Children
             111      and Youth At Risk Act, is repealed July 1, 2016.
             112          (8) Title 63, Chapter 88, Navajo Trust Fund, is repealed July 1, 2008.
             113          (9) Title 63, Chapter 99, Utah Commission on Aging, is repealed July 1, 2007.
             114          (10) [(a)] Section 63A-4-204 , authorizing the Risk Management Fund to provide
             115      coverage to any public school district that chooses to participate, is repealed July 1, 2016.
             116          [(b) Section 63A-4-205 , authorizing the Risk Management Fund to provide coverage to
             117      any local health department that chooses to participate, is repealed July 1, 2006.]
             118          (11) Section 63C-8-106 , Rural residency training program, is repealed July 1, 2015.
             119          Section 8. Section 63-55-267 is amended to read:
             120           63-55-267. Repeal dates, Title 67.


             121          (1) Section 67-1-15 is repealed December 31, [2007] 2017.
             122          (2) Sections 67-1a-10 and 67-1a-11 creating the Commission on Civic and Character
             123      Education and establishing its duties are repealed on July 1, 2011.
             124          Section 9. Section 63-55-278 is amended to read:
             125           63-55-278. Repeal dates, Title 78.
             126          (1) The Office of the Court Administrator, created in Section 78-3-23 , is repealed July
             127      1, 2008.
             128          (2) Foster care citizen review boards and steering committee, created in Title 78,
             129      Chapter 3g, is repealed July 1, [2007] 2012.
             130          (3) Alternative Dispute Resolution Act, created in Title 78, Chapter 31b, is repealed
             131      July 1, 2016.
             132          (4) Section 78-14-17 , regarding medical malpractice arbitration agreements, is repealed
             133      July 1, 2009.
             134          Section 10. Section 63-55b-126 is amended to read:
             135           63-55b-126. Repeal dates -- Title 26.
             136          (1) Section 26-38-4 is repealed January 1, 2009.
             137          (2) Title 26, Chapter 46, ["]Utah Health Care Workforce Financial Assistance
             138      Program,["] is repealed July 1, [2007] 2017.
             139          Section 11. Section 63-55b-153 is amended to read:
             140           63-55b-153. Repeal dates -- Titles 53, 53A, and 53B.
             141          [(1) Subsection 53-3-205 (9)(a)(i)(D) is repealed July 1, 2007.]
             142          [(2)] (1) Section 53-3-210 is repealed February 1, 2007.
             143          [(3) Subsection 53-3-804 (2)(g) is repealed July 1, 2007.]
             144          [(4)] (2) Section 53A-1-403.5 is repealed July 1, [2007] 2012.
             145          [(5)] (3) Subsection 53A-1a-511 (7)(c) is repealed July 1, 2007.
             146          [(6)] (4) Section 53A-3-702 is repealed July 1, 2008.
             147          [(7)] (5) Section 53A-6-112 is repealed July 1, 2009.
             148          [(8)] (6) Section 53A-17a-152 is repealed July 1, 2010.
             149          Section 12. Section 63-55b-178 is amended to read:
             150           63-55b-178. Repeal dates, Title 78.
             151          (1) Section 78-9-101 , Practicing law without a license, is repealed May 3, [2007] 2012.


             152          (2) Title 78, Chapter 60, Limitation of Judgments Against Governmental Entities Act,
             153      is repealed December 31, 2004.
