11 General Description:
12 This bill modifies provisions relating to the election of county legislative body
13 members in counties of the first and second class.
14 Highlighted Provisions:
15 This bill:
16 . requires counties of the first and second class to submit to voters a question whether
17 county council or commission members should be elected by district;
18 . states the phrasing for the ballot measure; and
19 . requires county council or commission members to be elected by district if the
20 measure is approved by voters.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 17-53-107 is enacted to read:
31 17-53-107. Ballot question on electing council or commission members by district.
32 (1) On or before the 2010 regular general election date, the legislative body of each
33 county of the first or second class shall submit to county voters a measure asking whether all
34 members of the county council or commission, as the case may be, should be elected by district
35 rather than at large.
36 (2) The ballot question at each election under Subsection (1) shall be phrased using
37 substantially the following language: "Should all members of the county (council or
38 commission, as the case may be) of (state the name of the county) be elected by districts of
39 equal population instead of at large?".
40 (3) If a majority of those voting in the county on the measure vote in favor of the
41 measure, all members of that county's council or commission shall, beginning the 2012 general
42 election, be elected by district.
43 (4) If a majority of those voting in the county on the measure vote against the measure,
44 the county council or commission, as the case may be, may continue to be elected as
45 previously.
