9 General Description:
10 This bill requires the Department of Health to provide financial assistance for room and
11 board to Medicaid clients participating in a new home and community-based services
12 long-term care program.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 26-18-404 is enacted to read:
31 26-18-404. Home and community-based long-term care -- Room and board
32 assistance.
33 If the department receives approval from the Centers for Medicare and Medicaid
34 Services within the U.S. Department of Health and Human Services to replace the Medicaid
35 program's current FlexCare program with a new program to provide long-term care services in
36 home and community-based settings rather than institutions, the department shall assist in the
37 payment of room and board costs for any person in the new program without sufficient income
38 to fully pay those costs.
39 Section 2. Appropriation.
40 As an ongoing appropriation subject to future budget constraints, there is appropriated
41 from the General Fund for fiscal year 2007-08, $393,000 to the Division of Health Care
42 Financing within the Department of Health to defray room and board costs for persons
43 participating in a home and community-based long-term care program approved by the Centers
44 for Medicare and Medicaid Services on or after January 1, 2007.
