             9      General Description:
             10          This bill modifies county and municipal land use development and management
             11      provisions.
             12      Highlighted Provisions:
             13          This bill:
             14          .    prohibits counties and municipalities from prohibiting activities associated with the
             15      collection and restoration of collector vehicles if the vehicles are kept out of
             16      ordinary public view.

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 10-9a-522 is enacted to read:


             28          10-9a-522. Automotive collection restrictions prohibited.
             29          (1) As used in this section:
             30          (a) "Automotive collection" means the collection and restoration of one or more
             31      collector vehicles, whether as a hobby or profession, including the storing of one or more parts
             32      cars.
             33          (b) "Automotive collector" means a person engaged in automotive collection, whether
             34      as a hobby or profession.
             35          (c) "Ordinary public view" means within the natural visual range of an individual on a
             36      public street or sidewalk.
             37          (d) "Parts car" means a motor vehicle that is not intended to be operated on a road but
             38      is used to provide parts for the restoration of other motor vehicles.
             39          (2) A municipality may not prohibit automotive collection, if the automotive collector
             40      keeps each collector vehicle and parts car out of ordinary public view by:
             41          (a) inside storage;
             42          (b) fencing;
             43          (c) trees or shrubbery; or
             44          (d) any other barrier.
             45          (3) An automotive collector may perform mechanical repairs or modifications to a
             46      vehicle located out of ordinary public view on private real property within a municipality.
             47          Section 2. Section 17-27a-521 is enacted to read:
             48          17-27a-521. Automotive collection restrictions prohibited.
             49          (1) As used in this section:
             50          (a) "Automotive collection" means the collection and restoration of one or more
             51      collector vehicles, whether as a hobby or profession, including the storing of one or more parts
             52      cars.
             53          (b) "Automotive collector" means a person engaged in automotive collection, whether
             54      as a hobby or profession.
             55          (c) "Ordinary public view" means within the natural visual range of an individual on a
             56      public street or sidewalk.
             57          (d) "Parts car" means a motor vehicle that is not intended to be operated on a road but
             58      is used to provide parts for the restoration of other motor vehicles.


             59          (2) A county may not prohibit automotive collection, if the automotive collector keeps
             60      each collector vehicle and parts car out of ordinary public view by:
             61          (a) inside storage;
             62          (b) fencing;
             63          (c) trees or shrubbery; or
             64          (d) any other barrier.
             65          (3) An automotive collector may perform mechanical repairs or modifications to a
             66      vehicle located out of ordinary public view on private real property within the unincorporated
             67      area of a county.
