9 General Description:
10 This bill establishes the process for entering into an agreement to divide groundwater
11 with another state.
12 Highlighted Provisions:
13 This bill:
14 . defines terms; and
15 . authorizes the executive director of the Department of Natural Resources to sign an
16 agreement dividing groundwater with another state only after the governor and the
17 Legislature approve the agreement in a concurrent resolution.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 73-1-21 is enacted to read:

28 73-1-21. Concurrent Resolution for an agreement to divide interstate
29 groundwater.
30 (1) As used in this section:
31 (a) "Agreement" means the agreement between Utah and Nevada to divide the water
32 resources of an interstate groundwater flow system required by the Lincoln County
33 Conservation, Recreation, and Development Act of 2004, Pub. L. No. 108-424.
34 (b) "Executive director" means the executive director of the Department of Natural
35 Resources.
36 (2) (a) The executive director shall submit the proposed agreement to the governor and
37 the Legislature.
38 (b) The executive director may execute the agreement after the governor and the
39 Legislature approve the agreement in a concurrent resolution.
40 (3) The agreement is void ab initio without the passage of the concurrent resolution
41 required by Subsection (2).
