Rep. Barrus called the meeting to order at 4:20 p.m.

MOTION:    Rep. Brown moved to approve the minutes of the February 15, 2008 meeting. The motion passed unanimously with Rep. Donnelsen, Rep. Noel, Rep. Painter and Rep. Sandstrom absent for the vote.

H.B. 394    Real Property Purchase - Notification of Water Rights (Rep. B. Ferry)

MOTION:    Rep. Mathis moved to amend the bill as follows:

1.    Page 1, Line 10 :    

             10          This bill requires a certain notification to be provided if
{   a   }        an approved or perfected       water right is included in a


2.    Page 1, Line 14 :    


             14          .    requires a notice to be provided to a purchaser of real property if
{   a   }        an approved or perfected       water right is


3.    Page 1, Line 17 :    

             17      concerning
{   a   }        an approved or perfected       water right included with the sale of real property may be made.


4.    Page 2, Lines 30 through 31 :    

             30          If the sale of real property includes
{   a   }        an approved or perfected       water right, the seller shall provide the buyer with:

             31          (1) notice that
{   a   }        an approved or perfected       water right is included; and


5.    Page 2, Line 37 :    

             37      required by Section 57-1-46 concerning the sale of real property that includes
{   a   }        an approved or perfected       water right.


6.    Page 2, Lines 39 through 40 :    

             39          (a) identification of the
  approved or perfected       water right;

             40          (b) the possibility for forfeiture of
{   a   }        an approved or perfected       water right if other provisions of law are not


    The motion passed unanimously with Rep. Donnelson and Rep. Sandstrom absent for the vote.

MOTION:    Rep. Mathis moved to pass the bill out favorably as amended.

Rep. Barrus relinquished the chair to Rep. Painter.

SUBSTITUTE
MOTION:    Rep. Barrus moved to hold the bill. The motion passed unanimously.

Rep. Barrus resumed the chair.



S.B. 170    Board of Water Resources Amendments (Sen. D. Stowell) (Rep. S. Andersen)

Sen. Stowell explained the bill to the committee.

Spoke for the bill:    Craig Peterson, Provo River Water Users Association

MOTION:    Rep. Winn moved to pass the bill out favorably. The motion passed unanimously with Rep. Donnelson, Rep. Draxler and Rep. Sandstrom absent for the vote.

MOTION:    Rep. Painter moved to place the bill on the consent calendar. The motion failed with Rep. Brown and Rep. Noel voting in the affirmative. Rep. Donnelson, Rep. Draxler and Rep. Sandstrom were absent for the vote.

S.J.R. 6    Joint Resolution Encouraging the Governor's Board Appointments to Reflect Utah Geographic Balance (Sen. D. Stowell) (Rep. M. Noel)

Sen. Stowell explained the bill to the committee.

MOTION:    Rep. Brown moved to pass the bill out favorably. The motion passed unanimously with Rep. Donnelson, Rep. Draxler, Rep. Painter and Rep. Sandstrom absent for the vote.

MOTION:    Rep. Brown moved to place SJR 6 on the consent calendar. The motion passed unanimously with Rep. Donelson, Rep. Draxler, Rep. Painter and Rep. Sandstrom absent for the vote.

MOTION:    Rep. Riesen moved to adjourn.
