             7      LONG TITLE
             8      General Description:
             9          This bill authorizes presidents of institutions of higher education and the State Board
             10      of Regents to reallocate certain appropriations.
             11      Highlighted Provisions:
             12          This bill:
             13          .    authorizes the presidents of institutions of higher education and the State Board of
             14      Regents to reallocate designated appropriations between line items.
             15      Monies Appropriated in this Bill:
             16          None
             17      Other Special Clauses:
             18          This bill provides an immediate effective date.

             23      Be it enacted by the Legislature of the state of Utah:
             24          Section 1. Section 53B-2-108.1 is enacted to read:
             25          53B-2-108.1. Appropriations reallocation.
             26          (1) Notwithstanding the requirements of Title 63J, Chapter 1, Budgetary Procedures
             27      Act, appropriations for the support of higher education for the fiscal year beginning July 1,
             28      2008 and ending June 30, 2009, may be reallocated between line items as provided in this
             29      section.


             30          (2) (a) The president of the University of Utah may reallocate between line items the
             31      appropriations:
             32          (i) described in Items 119-128 in S.B. 1, 2008 General Session; and
             33          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             34      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             35      Second Special Session.
             36          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             37      in the 2008 Second Special Session.
             38          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             39          (3) (a) The president of Utah State University may reallocate between line items the
             40      appropriations:
             41          (i) described in Items 129-137 in S.B. 1, 2008 General Session; and
             42          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             43      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             44      Second Special Session.
             45          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             46      in the 2008 Second Special Session.
             47          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             48          (4) (a) The president of Weber State University may reallocate between line items the
             49      appropriations:
             50          (i) described in Items 138 and 139 in S.B. 1, 2008 General Session; and
             51          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             52      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             53      Second Special Session.
             54          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             55      in the 2008 Second Special Session.
             56          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             57          (5) (a) The president of Southern Utah University may reallocate between line items


             58      the appropriations:
             59          (i) described in Items 140-143 in S.B. 1, 2008 General Session; and
             60          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             61      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             62      Second Special Session.
             63          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             64      in the 2008 Second Special Session.
             65          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             66          (6) (a) The president of Snow College may reallocate between line items the
             67      appropriations:
             68          (i) described in Items 144-146 in S.B. 1, 2008 General Session; and
             69          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             70      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             71      Second Special Session.
             72          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             73      in the 2008 Second Special Session.
             74          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             75          (7) (a) The president of Dixie State College may reallocate between line items the
             76      appropriations:
             77          (i) described in Items 147-149 in S.B. 1, 2008 General Session; and
             78          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             79      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             80      Second Special Session.
             81          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             82      in the 2008 Second Special Session.
             83          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             84          (8) (a) The president of the College of Eastern Utah may reallocate between line items
             85      the appropriations:


             86          (i) described in Items 150-153 in S.B. 1, 2008 General Session; and
             87          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             88      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             89      Second Special Session.
             90          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             91      in the 2008 Second Special Session.
             92          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             93          (9) (a) The president of Utah Valley University may reallocate between line items the
             94      appropriations:
             95          (i) described in Items 154 and 155 in S.B. 1, 2008 General Session; and
             96          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             97      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, S.B. 103, 2008 General
             98      Session, and S.B. 2001, 2008 Second Special Session.
             99          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             100      in the 2008 Second Special Session.
             101          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             102          (10) (a) The president of Salt Lake Community College may reallocate between line
             103      items the appropriations:
             104          (i) described in Items 156-158 in S.B. 1, 2008 General Session; and
             105          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             106      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             107      Second Special Session.
             108          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             109      in the 2008 Second Special Session.
             110          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             111          (11) (a) The State Board of Regents may reallocate between line items the
             112      appropriations:
             113          (i) described in Items 168-178 in S.B. 1, 2008 General Session and monies


             114      appropriated in H.B. 86, 2008 General Session, and S.B. 180, 2008 General Session; and
             115          (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
             116      Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
             117      Second Special Session.
             118          (b) (i) The total amount of money reallocated may not exceed the net reduction made
             119      in the 2008 Second Special Session.
             120          (ii) The money reallocated from each line item may not exceed 4% of the line item.
             121          Section 2. Effective date.
             122          If approved by two-thirds of all the members elected to each house, this bill takes effect
             123      upon approval by the governor, or the day following the constitutional time limit of Utah
             124      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             125      the date of veto override.
