8 General Description:
9 This bill authorizes presidents of institutions of higher education and the State Board of
10 Regents to reallocate certain appropriations.
11 Highlighted Provisions:
12 This bill:
13 . authorizes the presidents of institutions of higher education and the State Board of
14 Regents to reallocate designated appropriations between line items.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 53B-2-108.1 is enacted to read:
25 53B-2-108.1. Appropriations reallocation.
26 (1) Notwithstanding the requirements of Title 63J, Chapter 1, Budgetary Procedures
27 Act, appropriations for the support of higher education for the fiscal year beginning July 1,
28 2008 and ending June 30, 2009, may be reallocated between line items as provided in this
29 section.
30 (2) (a) The president of the University of Utah may reallocate between line items the
31 appropriations:
32 (i) described in Items 119-128 in S.B. 1, 2008 General Session; and
33 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
34 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
35 Second Special Session.
36 (b) The total amount of money reallocated may not exceed the net reduction made in
37 the 2008 Second Special Session.
38 (3) (a) The president of Utah State University may reallocate between line items the
39 appropriations:
40 (i) described in Items 129-137 in S.B. 1, 2008 General Session; and
41 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
42 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
43 Second Special Session.
44 (b) The total amount of money reallocated may not exceed the net reduction made in
45 the 2008 Second Special Session.
46 (4) (a) The president of Weber State University may reallocate between line items the
47 appropriations:
48 (i) described in Items 138 and 139 in S.B. 1, 2008 General Session; and
49 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
50 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
51 Second Special Session.
52 (b) The total amount of money reallocated may not exceed the net reduction made in
53 the 2008 Second Special Session.
54 (5) (a) The president of Southern Utah University may reallocate between line items
55 the appropriations:
56 (i) described in Items 140-143 in S.B. 1, 2008 General Session; and
57 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
58 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
59 Second Special Session.
60 (b) The total amount of money reallocated may not exceed the net reduction made in
61 the 2008 Second Special Session.
62 (6) (a) The president of Snow College may reallocate between line items the
63 appropriations:
64 (i) described in Items 144-146 in S.B. 1, 2008 General Session; and
65 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
66 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
67 Second Special Session.
68 (b) The total amount of money reallocated may not exceed the net reduction made in
69 the 2008 Second Special Session.
70 (7) (a) The president of Dixie State College may reallocate between line items the
71 appropriations:
72 (i) described in Items 147-149 in S.B. 1, 2008 General Session; and
73 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
74 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
75 Second Special Session.
76 (b) The total amount of money reallocated may not exceed the net reduction made in
77 the 2008 Second Special Session.
78 (8) (a) The president of the College of Eastern Utah may reallocate between line items
79 the appropriations:
80 (i) described in Items 150-153 in S.B. 1, 2008 General Session; and
81 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
82 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
83 Second Special Session.
84 (b) The total amount of money reallocated may not exceed the net reduction made in
85 the 2008 Second Special Session.
86 (9) (a) The president of Utah Valley University may reallocate between line items the
87 appropriations:
88 (i) described in Items 154 and 155 in S.B. 1, 2008 General Session; and
89 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
90 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, S.B. 103, 2008 General
91 Session, and S.B. 2001, 2008 Second Special Session.
92 (b) The total amount of money reallocated may not exceed the net reduction made in
93 the 2008 Second Special Session.
94 (10) (a) The president of Salt Lake Community College may reallocate between line
95 items the appropriations:
96 (i) described in Items 156-158 in S.B. 1, 2008 General Session; and
97 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
98 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
99 Second Special Session.
100 (b) The total amount of money reallocated may not exceed the net reduction made in
101 the 2008 Second Special Session.
102 (11) (a) The State Board of Regents may reallocate between line items the
103 appropriations:
104 (i) described in Items 168-178 in S.B. 1, 2008 General Session and monies
105 appropriated in H.B. 86, 2008 General Session, and S.B. 180, 2008 General Session; and
106 (ii) as modified by supplemental appropriations, including H.B. 2, 2008 General
107 Session, H.B. 3, 2008 General Session, H.B. 4, 2008 General Session, and S.B. 2001, 2008
108 Second Special Session.
109 (b) The total amount of money reallocated may not exceed the net reduction made in
110 the 2008 Second Special Session.
111 Section 2. Effective date.
112 If approved by two-thirds of all the members elected to each house, this bill takes effect
113 upon approval by the governor, or the day following the constitutional time limit of Utah
114 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
115 the date of veto override.
