             7      LONG TITLE
             8      General Description:
             9          This bill amends a provision relating to the Utah Office of Coal Mine Safety.
             10      Highlighted Provisions:
             11          This bill:
             12          .    authorizes the Utah Office of Coal Mine Safety to:
             13              .    receive reports regarding appropriations to promote mine safety; and
             14              .    evaluate the effectiveness of an appropriation; and
             15          .    establishes a one-time appropriation for miner safety training.
             16      Monies Appropriated in this Bill:
             17          This bill appropriates:
             18          .    $600,000 from the General Fund for fiscal year 2009-10 only, to the College of
             19      Eastern Utah - Western Energy Training Center for miner safety training.
             20      Other Special Clauses:
             21          None
             22      Utah Code Sections Affected:

             24          40-2-301, as enacted by Laws of Utah 2008, Chapter 113

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 40-2-301 is amended to read:


             28           40-2-301. Commission and office responsibilities.
             29          (1) The commissioner shall:
             30          (a) direct the state's efforts to promote coal mine safety; and
             31          (b) participate with the Mine Safety and Health Administration in an investigation of a
             32      major coal mine accident in Utah.
             33          (2) The commission shall establish by rule, made in accordance with Title 63G,
             34      Chapter 3, Utah Administrative Rulemaking Act:
             35          (a) a system consistent with Section 40-2-302 to receive, evaluate, and act on a report
             36      of an alleged unsafe condition at a coal mine; and
             37          (b) requirements for a coal mine operator regarding notification of a coal mine accident
             38      as part of a coal mine operator's emergency response plan.
             39          (3) The office may:
             40          (a) conduct one or more studies to promote coal mine safety;
             41          (b) cooperate with educational and other organizations to promote mining engineering
             42      and mine safety training;
             43          (c) establish a cooperative relationship with the Mine Safety and Health Administration
             44      to promote coal mine safety in Utah;
             45          (d) serve as the lead state agency in developing and implementing state and local
             46      response and communication plans for major coal mine accidents in Utah; [and]
             47          (e) implement the notification requirements established under Subsection (2)(b)[.];
             48          (f) receive a report from a recipient of an appropriation to promote mine training and
             49      safety; and
             50          (g) evaluate how effective an appropriation is in promoting mine training and safety.
             51          Section 2. Appropriation.
             52          (1) There is appropriated $600,000 from the General Fund for fiscal year 2009-10 only,
             53      to the College of Eastern Utah - Western Energy Training Center.
             54          (2) It is the intent of the Legislature that the College of Eastern Utah - Western Energy
             55      Training Center use the money appropriated in Subsection (1) to promote mine training and
             56      safety.
