8 General Description:
9 This bill provides that the tolling statute does not apply if jurisdiction can be obtained
10 using the long arm statute.

22 Be it enacted by the Legislature of the state of Utah:
23 Section 1. Section 78B-2-104 is amended to read:
24 78B-2-104. Effect of absence from state.
25 If a cause of action accrues against a person while the person is out of the state and the
26 person is not subject to the jurisdiction of the courts of this state in accordance with Section
27 78B-3-205 , the action may be commenced within the term as limited by this chapter after his
28 return to the state. If after a cause of action accrues the person departs from the state, the time
29 of his absence is not part of the time limited for the commencement of the action unless
30 Section 78B-3-205 applies.
