Madam Chair Fowlke called the meeting to order at 8:33 am and indicated that as the committee didn't have a quorum action on the minutes of January 30, 2009 would take place at the end of the meeting.

HB0127    Personal Injury Protection Coverage Amendments (Rep. T. Kiser)

The sponsor introduced the bill and explained its intent.

Chris Purcell, State Farm Insurance, spoke to the bill.

MOTION:
    Representative McIff moved to pass the bill out favorably. The motion passed unanimously with Representatives Allen, and Wheatley absent for the vote.

MOTION:    Representative McIff moved to place the bill on the Consent Calendar. The motion passed unanimously with Representatives Allen, and Wheatley absent for the vote.

HB0228    Assault on Service Member in Uniform (Rep. E. Hutchings)


The sponsor introduced the bill and explained its intent. Colonel Scott Olsen, Utah National Guard, Military Legal Liaison to the Legislature, assisted the sponsor in the presentation and answered questions from the committee.



MOTION:    Representative Johnson moved to pass the bill out favorably. The motion passed unanimously.

Madam Chair Fowlke called on Representative Ipson for a motion to approve the minutes of January 30, 2009.

MOTION:    Representative Ispon moved to approve the minutes of January 30, 2009. The motion passed unanimously.

HB0263    Insurance Fraud Related Assessments (Rep. D. Aagard)

The sponsor introduced the bill and explained its intent. Neil Gooch, Deputy Commissioner, Insurance Commission, assisted in the presentation and addressed questions from the committee.

Armond Glick, Director, Insurance Fraud Division, addressed questions from the committee.

Kelly Atkinson, Executive Director, Utah Health Insurance Association, spoke in opposition to the rate increases in the bill as it relates to Health Insurance. Rolayn Fairley, AAA of Utah, spoke in support of the bill. Jeff Hartley, National Trade Association of Health Insurance Plans, spoke in opposition to the bill. Kent Michie, Commissioner, Utah Insurance Department , spoke in favor of the bill.

MOTION:
    Representative King moved to pass the bill out favorably. The motion passed 9-2- 2 with Representatives Bird and Hutchings voting in opposition to the motion.

MOTION:    Representative Gibson moved to adjourn the meeting. The motion passed unanimously. Madam Chair Fowlke adjourned the meeting at 9:55 am.
