             9      General Description:
             10          This bill modifies the Utah Construction Trades Licensing Act.
             11      Highlighted Provisions:
             12          This bill:
             13          .    establishes continuing education requirements for electricians and plumbers; and
             14          .    requires the Division of Occupational and Professional Licensing to establish a
             15      continuing education program and provides for its administration.

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 58-55-302.7 is enacted to read:


             28          58-55-302.7. Continuing education requirements for electricians and plumbers.
             29          (1) As used in this section:
             30          (a) "Licensed electrician" means an individual licensed under this chapter as an
             31      apprentice electrician, journeyman electrician, H. [ or ] .H master electrician H. , residential
             31a      journeyman electrician, or residential master electrician .H .
             32          (b) "Licensed plumber" means an individual licensed under this chapter as an
             33      apprentice plumber, journeyman plumber, H. [ or ] .H master plumber H. , residential
             33a      journeyman plumber, or residential master plumber .H .
             34          (2) H. [ During ] Beginning December 1, 2010, during .H each two-year renewal cycle
             34a      established by rule under Subsection
             35      58-55-303 (1):
             36          (a) a licensed electrician shall complete H. [ the number of ] 16 .H hours of continuing
             36a      education
             37      H. [ that the division specifies ] .H under the continuing education program established under this
             38      section; and
             39          (b) a licensed plumber shall complete H. [ the number of ] 12 .H hours of continuing
             39a      education H. [ that
             40      the division specifies
] .H
under the continuing education program established under this section.
             41          (3) The commission shall, with the concurrence of the division, establish by rule:
             42          (a) a continuing education program for licensed electricians; and
             43          (b) a continuing education program for licensed plumbers.
             44          (4) The division may contract with a person to establish and maintain a continuing
             45      education registry to include:
             46          (a) an online application for a continuing education course provider to apply to the
             47      division for approval of the course for inclusion in the continuing education program;
             48          (b) a list of courses that the division has approved for inclusion in the continuing
             49      education program; and
             50          (c) a list of courses that:
             51          (i) a licensed electrician or licensed plumber has completed under the continuing
             52      education program; and
             53          (ii) the licensed electrician or licensed plumber may access to monitor compliance with
             54      the continuing education requirement under Subsection (2).
             55          (5) The division may charge a fee, established by the division under Section 63J-1-504 ,
             56      to administer the requirements of this section.
             57          Section 2. Section 58-55-303 is amended to read:
             58           58-55-303. Term of license -- Expiration -- Renewal.


             59          (1) Each license issued under this chapter shall be issued in accordance with a two-year
             60      renewal cycle established by rule. The division may by rule extend or shorten a renewal period
             61      by as much as one year to stagger the renewal cycle it administers.
             62          (2) At the time of renewal, the licensee shall show satisfactory evidence of:
             63          (a) continuing financial responsibility as required under Section 58-55-306 [.]; and
             64          (b) if the licensee is an apprentice electrician or plumber, journeyman electrician or
             65      plumber, H. [ or ] .H master electrician or plumber, H. residential journeyman electrician or
             65a      plumber, or residential master electrician or plumber, .H completion of the number of hours of
             65b      continuing
             66      education H. [ that the division specifies under a continuing education program that the division
             67      establishes
] specified .H
under Section 58-55-302.7 .
             68          (3) Each license automatically expires on the expiration date shown on the license
             69      unless the licensee renews the license in accordance with Section 58-1-308 .
             70          (4) The requirements of Subsection 58-55-302 (9) shall also apply to applicants seeking
             71      to renew or reinstate a license.
             72          (5) In addition to any other requirements imposed by law, if a license has been
             73      suspended or revoked for any reason, the applicant must pay in full all fines imposed by the
             74      division, resolve any outstanding citations or disciplinary actions with the division, satisfy any
             75      Section 58-55-503 judgment and sentence or nontrial resolution, complete a new financial
             76      responsibility review as required under Section 58-55-306 , using only titled assets, and pay in
             77      full any reimbursement amount as provided in Title 38, Chapter 11, Residence Lien Restriction
             78      and Lien Recovery Fund Act.
