8 LONG TITLE
9 General Description:
10 This joint resolution of the Legislature proposes to amend the Education Article of the
11 Utah Constitution.
12 Highlighted Provisions:
13 This resolution proposes to amend the Utah Constitution to:
14 . H. [
15 be imposed;
16 . authorize the Legislature to allow:
17 . a requirement that elementary and secondary school students provide their own
18 school supplies or pay a fee for those supplies; and
19 . the granting of waivers for fees or a requirement to provide school supplies, in
20 the case of financial hardship; and
21 . make technical changes.
22 Special Clauses:
23 This resolution directs the lieutenant governor to submit this proposal to voters.
24 This resolution provides a contingent effective date of January 1, 2011 for this proposal.

29 Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
30 of the two houses voting in favor thereof:
31 Section 1. It is proposed to amend Utah Constitution Article X, Section 2, to read:
32 Article X, Section 2. [Defining what shall constitute the public school system.]
33 (1) (a) The public education system shall include all public elementary and secondary
34 schools and such other schools and programs [

37 (b) Public elementary and secondary schools shall be free, except that the Legislature
38 may by statute:
39 (i) authorize the imposition of fees in the secondary schools[
40 outside of regular school hours
41 (ii) authorize a requirement that students in elementary and secondary schools provide
42 their own school supplies or pay a fee for school supplies; and
43 (iii) authorize the granting of waivers of any of the fees or requirements of this
44 Subsection (1)(b) in the case of financial hardship.
45 (2) The higher education system shall include all public universities and colleges and
46 such other institutions and programs that the Legislature designates by statute.
47 Section 2. Submittal to voters.
48 The lieutenant governor is directed to submit this proposed amendment to the voters of
49 the state at the next regular general election in the manner provided by law.
50 Section 3. Effective date.
51 If the amendment proposed by this joint resolution is approved by a majority of those
52 voting on it at the next regular general election, the amendment shall take effect on January 1,
53 2011.
