             9      LONG TITLE
             10      General Description:
             11          This concurrent resolution of the Legislature and the Governor gives approval for the
             12      operation of a landfill to receive specified nonhazardous solid waste.
             13      Highlighted Provisions:
             14          This resolution:
             15          .    addresses the proposed Mountain View Landfill, that is owned by Mountain View
             16      Landfill, Inc., and that is located in Salt Lake City, in Salt Lake County;
             17          .    grants statutorily required approval of the operating plan, as approved by the
             18      Department of Environmental Quality, and allows the Mountain View Landfill to
             19      operate as a Class V landfill and receive nonhazardous waste, industrial waste,
             20      construction and demolition waste, and special wastes as enumerated;
             21           . S. [ reiterates that the Mountain View Landfill is required under state law to apply for
             22      and receive approval from the Department of Environmental Quality in order to
             23      receive an exemption from the daily cover requirement;

             24          .    reiterates that the Mountain View Landfill is required under state law to apply for
             25      and receive approval from the Department of Environmental Quality, if the landfill
             26      desires to change a specified element of its waste stream.

             30      Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
             31          WHEREAS, Mountain View Landfill Inc., desires to construct and operate a Class V
             32      commercial landfill to receive nonhazardous solid waste for disposal as defined in Section
             33      19-6-102 ;
             34          WHEREAS, the facility is to be located at the site currently known as the Mountain
             35      View Landfill;
             36          WHEREAS, this site is a rectangularly shaped 76-acre parcel in Section 10, Township 1
             37      South, Range 2 West, Salt Lake Base and Meridian, and is located approximately nine miles
             38      west of downtown Salt Lake City, in Salt Lake County;
             39          WHEREAS, Mountain View Landfill, Inc., currently holds a permit to operate at this
             40      site a S. [ noncommercial ] commercial .S , nonhazardous solid waste facility that would only
             40a      receive construction
             41      and demolition waste S. [ under contract with local businesses and individuals ] .S ;
             42          WHEREAS, Section 19-6-108 requires that an applicant for authority to construct a
             43      commercial landfill receive approval from the Utah State Legislature and the Governor of the
             44      State as a part of the approval process;
             45          WHEREAS, Section 19-6-108 also requires that an applicant for authority to operate a
             46      commercial landfill receive approval from the executive secretary of the Solid and Hazardous
             47      Waste Control Board within the Department of Environmental Quality prior to receiving
             48      legislative and gubernatorial approval;
             49          WHEREAS, Mountain View Landfill, Inc., has submitted a proposed operation plan for
             50      the Mountain View Landfill as a Class V commercial, nonhazardous solid waste landfill to the
             51      Department of Environmental Quality, and the operation plan was approved by the executive
             52      secretary of the Solid and Hazardous Waste Control Board on February S. [ 8 ] 10 .S , 2010, with an
             53      effective approval date of February S. [ 8 ] 10 .S , 2010; S. and .S
             54          WHEREAS, the approved operating plan for the Mountain View Landfill allows the
             55      landfill to receive nonhazardous construction and demolition waste, including asbestos waste,
             56      as enumerated in the operation plan and in the plan approval of the executive secretary, and as
             57      defined in Administrative Rule R315-315, Special Waste Requirements S. [ ; and
             58          WHEREAS, the approved operating plan requires, under Title 19, Environmental
] .S

     S. [ Quality Code, that the landfill provide daily cover, and this requirement may be changed only
             60      upon application to the Department of Environmental Quality, review by the department of the
             61      effectiveness of the proposed alternative to the daily cover, and a determination by the
             62      department that the alternative meets the landfill maintenance requirements no less effectively
             63      than a daily cover

             64          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
             65      Governor concurring therein, grant their approval to Mountain View Landfill, Inc. to construct
             66      and operate a Class V commercial, nonhazardous solid waste landfill known as the Mountain
             67      View Landfill in Salt Lake City, Utah.
