9 General Description:
10 This bill amends the State Capitol Preservation Board fee schedule for the current
11 fiscal year.
12 Highlighted Provisions:
13 This bill:
14 . establishes rental rates for State Capitol facilities during the 2010 General Session
15 of the Utah State Legislature.

19 This bill provides an immediate effective date.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Fee schedule.
25 (1) As used in this section, "an event related to the General Session of the Legislature"
26 means an event held for the primary purpose of:
27 (a) discussing public policy germane to the legislative session; or
28 (b) meeting with a legislator.
29 (2) Notwithstanding the fees and rates for the State Capitol Preservation Board
30 contained in Laws of Utah 2009, Chapter 396, Section 2, the following fees and rates for an
31 event related to the General Session of the Legislature are established under Title 63J, Chapter
32 1, Budgetary Procedures Act, for fiscal year ending June 30, 2010:
33 (a) (i) During the hours of 7 a.m. to 5:30 p.m. on a Monday, Tuesday, Wednesday,
34 Thursday, or Friday that is on a date on or between January 25, 2010 and March 11, 2010,
35 there is a rental rate of $0 for the following rooms located in:
36 (A) the State Office Building:
37 (I) Room B110; and
38 (II) Room 1112; and
39 (B) the State Capitol:
40 (I) Room 130;
41 (II) Room 170; and
42 (III) Room 210.
43 (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
44 time a person may use a room listed in Subsection (2)(a)(i) at the rental rate established in
45 Subsection (2)(a)(i).
46 (B) A person using a room listed in Subsection (2)(a)(i) in excess of the time
47 established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
48 Section 2.
49 (b) (i) During the hours of 7 a.m. to 11 a.m. and 1:30 p.m. to 5:30 p.m. on a Monday,
50 Tuesday, Wednesday, Thursday, or Friday that is on a date on or between January 25, 2010
51 and March 11, 2010, there is a rental rate of $0 for the following rooms located in the Senate
52 Building:
53 (A) Kletting Room;
54 (B) Olmstead Room;
55 (C) Spruce Room;
56 (D) Beehive Room;
57 (E) Seagull Room; and
58 (F) Copper Room.
59 (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
60 time a person may use a room listed in Subsection (2)(b)(i) at the rental rate established in
61 Subsection (2)(b)(i).
62 (B) A person using a room listed in Subsection (2)(b)(i) in excess of the time
63 established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
64 Section 2.
65 (c) (i) During the hours of 11 a.m. to 1:30 p.m. on a Monday, Tuesday, Wednesday,
66 Thursday, or Friday that is on a date on or between January 25, 2010 and March 11, 2010,
67 there is a rental rate of $0 for the following rooms located in the Senate Building if the renter
68 uses a preferred caterer to provide food services during the room rental or provides evidence
69 that attendees have purchased food from a preferred caterer:
70 (A) Kletting Room;
71 (B) Olmstead Room;
72 (C) Spruce Room;
73 (D) Beehive Room;
74 (E) Seagull Room; and
75 (F) Copper Room.
76 (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
77 time a person may use a room listed in Subsection (2)(c)(i) at the rental rate established in
78 Subsection (2)(c)(i).
79 (B) A person using a room listed in Subsection (2)(c)(i) in excess of the time
80 established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
81 Section 2.
82 (d) (i) (A) During the hours of 7 a.m. to 11 a.m. and 1:30 p.m. to 5:30 p.m. on a
83 Monday, Tuesday, Wednesday, Thursday, or Friday that is on a date on or between January
84 25, 2010 and March 11, 2010, the State Office Building Auditorium has the following rental
85 rates:
86 (I) $50 per hour, if the renter is a non-profit organization; and
87 (II) $100 per hour, if the renter is a for profit organization.
88 (B) During the hours of 11 a.m. to 1:30 p.m. on a Monday, Tuesday, Wednesday,
89 Thursday, or Friday that is on a date on or between January 25, 2010 and March 11, 2010, the
90 State Office Building Auditorium has the following rental rates:
91 (I) $0, if the renter:
92 (Aa) uses a preferred caterer to provide food services during the room rental; or
93 (Bb) provides evidence that attendees have purchased food from a preferred caterer;
94 (II) $50 per hour, if the renter:
95 (Aa) is a non-profit organization; and
96 (Bb) does not provide evidence that meals served in the auditorium were purchased
97 from a preferred caterer; and
98 (III) $100 per hour if the renter:
99 (Aa) is a for profit organization; and
100 (Bb) does not provide evidence that meals served in the auditorium were purchased
101 from a preferred caterer.
102 (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
103 time a person may use the auditorium at the rental rate established in Subsection (2)(d)(i).
104 (B) A person using the State Office Building Auditorium in excess of the time
105 established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
106 Section 2.
107 (e) (i) On a date on or between January 25, 2010 and March 11, 2010, the State
108 Capitol Board Room has the following rental rates:
109 (A) $75 per hour for a non-profit organization; and
110 (B) $150 per hour for a for profit organization.
111 (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
112 time a person may use the State Capitol Board Room at the rental rates established in
113 Subsection (2)(e)(i).
114 (B) A person using the State Capitol Board Room in excess of the time established by
115 rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396, Section 2.
116 (f) (i) During the hours of 7 a.m. to 5:30 p.m. on a date on or between January 25,
117 2010 and March 11, 2010, there is a rental rate of $0 for the following:
118 (A) the Capitol Rotunda; and
119 (B) the Hall of Governors.
120 (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
121 time a person may use a facility listed in Subsection (2)(f)(i) at the rental rate established in
122 Subsection (2)(f)(i).
123 (B) A person using a facility listed in Subsection (2)(f)(i) in excess of the time
124 established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
125 Section 2.
126 Section 2. Effective date.
127 If approved by two-thirds of all the members elected to each house, this bill takes effect
128 upon approval by the governor, or the day following the constitutional time limit of Utah
129 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
130 the date of veto override.
