             8      LONG TITLE
             9      General Description:
             10          This bill amends provisions relating to the termination of a billboard and associated
             11      rights.
             12      Highlighted Provisions:
             13          This bill:
             14          .    prohibits a municipality or a county from requiring that a lawfully erected billboard
             15      or associated property right be removed, modified, discontinued, or not renewed as
             16      a condition to a land use permit, license, variance, or other order or decision
             17      concerning land use or development; and
             18          .    makes technical corrections.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 10-9a-512 is amended to read:
             30           10-9a-512. Termination of a billboard and associated rights -- Conditions on land
             31      use applicant prohibited.
             32          (1) A municipality may only require termination of a billboard and associated property
             33      rights through:
             34          (a) gift;
             35          (b) purchase;
             36          (c) agreement;
             37          (d) exchange; or
             38          (e) eminent domain.
             39          (2) A termination under Subsection (1)(a), (b), (c), or (d) requires the voluntary consent
             40      of the billboard owner.
             41          (3) A municipality may not require that a lawfully erected billboard or associated
             42      property right be removed, modified, discontinued, or not renewed as a condition of issuing to
             43      a land use applicant:
             44          (a) a permit;
             45          (b) a license;
             46          (c) a variance; or
             47          (d) any other municipal order or decision concerning land use or development.
             48          Section 2. Section 17-27a-511 is amended to read:
             49           17-27a-511. Termination of a billboard and associated rights -- Conditions on
             50      land use applicant prohibited.
             51          (1) A county may only require termination of a billboard and associated property rights
             52      through:
             53          (a) gift;
             54          (b) purchase;
             55          (c) agreement;
             56          (d) exchange; or
             57          (e) eminent domain.
             58          (2) A termination under Subsection (1)(a), (b), (c), or (d) requires the voluntary consent


             59      of the billboard owner.
             60          (3) A county may not require that a lawfully erected billboard or associated property
             61      right be removed, modified, discontinued, or not renewed as a condition of issuing to a land
