             7      LONG TITLE
             8      General Description:
             9          This bill allows collectors to consolidate a single debtor's accounts into a single action
             10      for purposes of litigation.
             11      Highlighted Provisions:
             12          This bill:
             13          .    allows collectors to consolidate a single debtor's accounts into a single action for
             14      purposes of litigation; and
             15          .    makes technical corrections.
             16      Monies Appropriated in this Bill:

             21      AMENDS:
             22          12-1-8, as last amended by Laws of Utah 1998, Chapter 171

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 12-1-8 is amended to read:
             26           12-1-8. Designating and limiting activities as to assignments.
             27          (1) (a) Any collector having complied with the provisions of this chapter, may receive


             28      accounts, bills or other indebtedness, take assignments for the purpose of collections, and at the
             29      direction of the assignor bring suit as assignee[, provided however, that all accounts shall be].
             30          (b) A collector may consolidate assigned accounts into a single action setting forth
             31      multiple claims for purposes of litigation if:
             32          (i) the accounts consolidated into a single action are for a single debtor; and
             33          (ii) each account that is consolidated is within the statute of limitations as provided by
             34      law.
             35          (2) All legal processes, pleadings, and court representations shall be prepared and
             36      conducted by a duly licensed attorney, and a copy of summons and complaint, in all cases, shall
             37      be served on defendants.
