8 LONG TITLE
9 General Description:
10 This joint resolution of the Legislature authorizes the Utah Division of Facilities
11 Construction and Management to enter into a contract with a lessee to lease the Rio
12 Grande Depot.
13 Highlighted Provisions:
14 This resolution:
15 . authorizes the Utah Division of Facilities Construction and Management to enter
16 into a contract with a lessee to lease the Rio Grande Depot for a public market or a
17 related use.
18 Special Clauses:

21 Be it resolved by the Legislature of the state of Utah:
22 WHEREAS, the Utah Division of Facilities Construction and Management (DFCM)
23 may enter into a lease with another entity to secure needed facilities;
24 WHEREAS, the Rio Grande Depot in downtown Salt Lake City has great cultural and
25 historical significance to the state and its people;
26 WHEREAS, DFCM may wish to enter into a lease with a lessee for purposes of a
27 market or a related use in the Rio Grande Depot that is open to the public and in the
28 appropriate portion of the facility as determined by DFCM;
29 WHEREAS, the facility subject to the lease must meet all the building codes and

30 historical preservation requirements normally applied to buildings of historical significance as
31 well as all other applicable codes and requirements for the intended use, none of which shall be
32 at the cost of the state of Utah or any entity of the state of Utah; and
33 WHEREAS, the lease document shall be subject to the terms and conditions
34 customarily required by DFCM as well as requirements of the Utah Attorney General's Office
35 and the Division of Risk Management in order to protect the facility, persons, and property:
36 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
37 authorizes the Utah Division of Facilities Construction and Management to negotiate and enter
38 into a contract with a lessee to lease the Rio Grande Depot, in the appropriate portion of the
39 facility as determined by DFCM, for purposes of a public market or a related use, upon terms
40 mutually acceptable to both the lessor and the lessee.
41 BE IT FURTHER RESOLVED that a copy of this resolution shall be sent to the Utah
42 State Building Board and the Utah Division of Facilities Construction and Management.
