First Substitute H.B. 92

             7      LONG TITLE
             8      General Description:
             9          This bill enacts language related to regional service centers.
             10      Highlighted Provisions:
             11          This bill:
             12          .    allows and encourages local school boards to enter into an interlocal agreement to
             13      create a regional service center to provide education related services;
             14          .    requires a regional service center to be formed by an interlocal agreement to receive
             15      state funding;
             16          .    provides that an interlocal agreement may confirm or formalize a regional service
             17      center in operation before a certain date;
             18          .    requires the State Board of Education to make rules regarding regional service
             19      centers; and
             20          .    provides that a charter school may enter into a contract with an eligible regional
             21      service center to provide education related services to the charter school.

             30      Be it enacted by the Legislature of the state of Utah:
             31          Section 1. Section 53A-3-429 is enacted to read:
             32          53A-3-429. Regional service centers.
             33          (1) For purposes of this section, "eligible regional service center" means a regional
             34      service center formed by two or more school districts as an interlocal entity, in accordance with
             35      Title 11, Chapter 13, Interlocal Cooperation Act.
             36          (2) The Legislature strongly encourages school districts to collaborate and cooperate to
             37      provide educational services in a manner that will best utilize resources for the overall
             38      operation of the public education system.
             39          (3) An eligible regional service center formed by an interlocal agreement, in
             40      accordance with Title 11, Chapter 13, Interlocal Cooperation Act, may receive a distribution
             41      described in Subsection (5) if the Legislature appropriates money for eligible regional service
             42      centers.
             43          (4) (a) If local school boards enter into an interlocal agreement to confirm or formalize
             44      a regional service center in operation before July 1, 2011, the interlocal agreement may not
             45      eliminate any rights or obligations of the regional service center in effect before entering into
             46      the interlocal agreement.
             47          (b) An interlocal agreement entered into to confirm or formalize an existing regional
             48      service center shall have the effect of confirming and ratifying in the regional service center,
             49      the title to any property held in the name, or for the benefit of the regional service center as of
             50      the effective date of the interlocal agreement.
             51          (5) (a) The State Board of Education shall distribute any funding appropriated to
             52      eligible regional service centers as provided by the Legislature.
             53          (b) The State Board of Education may provide funding to an eligible regional service
             54      center in addition to legislative appropriations.
             55          (6) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
             56      State Board of Education shall make rules regarding eligible regional service centers including:


             57          (a) the distribution of legislative appropriations to eligible regional service centers;
             58          (b) the designation of eligible regional service centers as agents to distribute Utah
             59      Education Network services; and
             60          (c) the designation of eligible regional service centers as agents for regional
             61      coordination of public education and higher education services.
             62          (7) A public school that is a charter school may enter into a contract with an eligible
             63      regional service center to receive education related services from the eligible regional service
             64      center.
