7 LONG TITLE
8 General Description:
9 This joint resolution of the Legislature proposes to amend the Utah Constitution to
10 modify a provision relating to the public education system.
11 Highlighted Provisions:
12 This resolution proposes to amend the Utah Constitution to:
13 . provide that nothing in the Education article may be construed to limit a school or
14 teacher within the public education system from asking a student to voluntarily
15 provide school supplies for the student's own use.
16 Special Clauses:
17 This resolution directs the lieutenant governor to submit this proposal to voters.
18 This resolution provides a contingent effective date of January 1, 2013 for this proposal.

23 Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
24 of the two houses voting in favor thereof:
25 Section 1. It is proposed to amend Utah Constitution Article X, Section 2, to read:
26 Article X, Section 2. [Defining the public school system and the higher education
27 system -- Public schools to be free -- Exception -- School supplies.]
28 The public education system shall include all public elementary and secondary schools
29 and such other schools and programs as the Legislature may designate. The higher education
30 system shall include all public universities and colleges and such other institutions and
31 programs as the Legislature may designate. Public elementary and secondary schools shall be
32 free, except the Legislature may authorize the imposition of fees in the secondary schools.
33 Nothing in this article may be construed to limit a school or teacher within the public education
34 system from asking a student to voluntarily provide school supplies for the student's own use.
35 Section 2. Submittal to voters.
36 The lieutenant governor is directed to submit this proposed amendment to the voters of
37 the state at the next regular general election in the manner provided by law.
38 Section 3. Effective date.
39 If the amendment proposed by this joint resolution is approved by a majority of those
40 voting on it at the next regular general election, the amendment shall take effect on January 1,
41 2013.
