8 LONG TITLE
9 General Description:
10 This joint resolution of the Legislature proposes to amend the Utah Constitution to
11 modify a provision relating to eligibility to serve in the Legislature.
12 Highlighted Provisions:
13 This resolution proposes to amend the Utah Constitution to:
14 . prohibit registered lobbyists from being members of the Legislature.
15 Special Clauses:
16 This resolution directs the lieutenant governor to submit this proposal to voters.
17 This resolution provides a contingent effective date of January 1, 2013, for this
18 proposal.

23 Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
24 of the two houses voting in favor thereof:
25 Section 1. It is proposed to amend Utah Constitution Article VI, Section 6, to read:
26 Article VI, Section 6. [Who ineligible as legislator.]
27 No person holding any public office of profit or trust under authority of the United
28 States, or of this State, and no person who is a registered lobbyist, shall be a member of the
29 Legislature: Provided That appointments in the State Militia, and the offices of notary public,
30 justice of the peace, United States commissioner, and postmaster of the fourth class, shall not,
31 within the meaning of this section, be considered offices of profit or trust.
32 Section 2. Submittal to voters.
33 The lieutenant governor is directed to submit this proposed amendment to the voters of
34 the state at the next regular general election in the manner provided by law.
35 Section 3. Effective date.
36 If the amendment proposed by this joint resolution is approved by a majority of those
37 voting on it at the next regular general election, the amendment shall take effect on January 1,
38 2013.
