             8      General Description:
             9          This bill imposes a fee and creates an account to fund a program to control predatory
             10      animals.
             11      Highlighted Provisions:
             12          This bill:
             13          .    imposes a fee of $3 on certain hunting permits to be deposited into the Predator
             14      Control Restricted Account;
             15          .    creates the Predator Control Restricted Account within the General Fund;
             16          .    provides for the expenditure of money from the restricted account to fund a predator
             17      control program; and
             18          .    makes technical changes.

             31      Be it enacted by the Legislature of the state of Utah:
             32          Section 1. Section 23-19-22 is amended to read:
             33           23-19-22. Big game hunting permit.
             34          (1) A person who is at least 12 years old, upon paying the big game hunting permit fee
             35      established by the Wildlife Board, paying the fee established by Subsection (5), and possessing
             36      a valid hunting or combination license, may apply for or obtain a permit to hunt big game as
             37      provided by rules and proclamations of the Wildlife Board.
             38          (2) (a) A person who is 11 years old may apply for or obtain a big game hunting permit
             39      consistent with the requirements of Subsection (1) if that person's 12th birthday falls within the
             40      calendar year for which the permit is issued.
             41          (b) A person may not use a permit to hunt big game before the person's 12th birthday.
             42          (3) (a) Except as provided by Subsection (3)(b), a person who is younger than 14 years
             43      old may not apply for or obtain the following types of big game permits issued by the division
             44      through a public drawing:
             45          (i) premium limited entry;
             46          (ii) limited entry;
             47          (iii) once-in-a-lifetime; and
             48          (iv) cooperative wildlife management unit.
             49          (b) A person who is 13 years old may obtain a type of permit listed in Subsection (3)(a)
             50      if that person's 14th birthday falls within the calendar year for which the permit is issued.
             51          (4) One dollar of each big game permit fee collected from a resident shall be used for
             52      the hunter education program as provided in Section 23-19-17 .
             53          (5) There is established a fee in the amount of $3 added to each permit under this
             54      section to be deposited in the Predator Control Restricted Account.
             55          Section 2. Section 23-19-22.5 is amended to read:
             56           23-19-22.5. Cougar or bear hunting permit.
             57          (1) A person 12 years of age or older, upon paying the cougar or bear hunting permit
             58      fee established by the Wildlife Board, paying the fee established by Subsection (4), and


             59      possessing a valid hunting or combination license, may apply for or obtain a permit to take
             60      cougar or bear as provided by rules and proclamations of the Wildlife Board.
             61          (2) A person 11 years of age may apply for or obtain a cougar or bear hunting permit
             62      consistent with the requirements of Subsection (1) if that person's 12th birthday falls within the
             63      calendar year in which the permit is issued.
             64          (3) One dollar of each cougar or bear permit fee collected from a resident shall be used
             65      for the hunter education program.
             66          (4) There is established a fee in the amount of $3 added to each permit under this
             67      section to be deposited in the Predator Control Restricted Account.
             68          Section 3. Section 23-19-22.6 is amended to read:
             69           23-19-22.6. Turkey hunting permit -- Use of fee.
             70          (1) A person, upon paying the turkey permit fee established by the Wildlife Board,
             71      paying the fee established by Subsection (3), and possessing a valid hunting or combination
             72      license, may apply for or obtain a permit to take turkey as provided by rules and proclamations
             73      of the Wildlife Board.
             74          (2) One dollar of each turkey permit fee collected from a resident shall be used for the
             75      hunter education program.
             76          (3) There is established a fee in the amount of $3 added to each permit under this
             77      section to be deposited in the Predator Control Restricted Account.
             78          Section 4. Section 23-19-48 is enacted to read:
             79          23-19-48. Predator Control Restricted Account -- Contents -- Use of funds.
             80          (1) There is created a restricted account within the General Fund known as the Predator
             81      Control Restricted Account.
             82          (2) The restricted account includes:
             83          (a) deposits made to the restricted account from fees established on hunting permits, in
             84      accordance with Sections 23-19-22 , 23-19-22.5 , and 23-19-22.6 ; and
             85          (b) any other amounts deposited in the restricted account from donations or
             86      appropriations.
             87          (3) Money from the restricted account shall be used by the division to fund a predator
             88      control program to control populations of predatory animals that endanger the health of
             89      non-predatory wildlife populations in the state.


             90          (4) A predator control program shall be approved by the board before money may be
             91      spent from the restricted account to fund the program.
