8 General Description:
9 This bill reauthorizes certain state entities and programs that would otherwise sunset
10 before the 2012 or 2013 Annual General Session of the Utah Legislature.
11 Highlighted Provisions:
12 This bill:
13 . reauthorizes certain named state entities and programs that are scheduled to sunset
14 before the 2012 or 2013 Annual General Session; and
15 . makes technical changes.

30 Be it enacted by the Legislature of the state of Utah:
31 Section 1. Section 63I-1-226 is amended to read:
32 63I-1-226. Repeal dates, Title 26.
33 (1) Title 26, Chapter 9f, Utah Digital Health Service Commission Act, is repealed July
34 1, 2015.
35 (2) Section 26-18-12 , Expansion of 340B drug pricing programs, is repealed July 1,
36 2013.
37 (3) Title 26, Chapter 33a, Utah Health Data Authority Act, is repealed July 1, 2014.
38 (4) Section 26-21-23 , Licensing of non-Medicaid nursing care facility beds, is repealed

42 Section 2. Section 63I-1-231 is amended to read:

50 Section 3. Section 63I-1-253 is amended to read:
51 63I-1-253. Repeal dates, Titles 53, 53A, and 53B.
52 The following provisions are repealed on the following dates:
53 (1) Section 53-3-232 , Conditional licenses, is repealed July 1, 2015.
54 (2) Title 53A, Chapter 1a, Part 6, Public Education Job Enhancement Program is
55 repealed July 1, 2020.
56 (3) Title 53A, Chapter 1a, Part 9, Voluntary Extended-day Kindergarten Program, is
57 repealed July 1, 2011.
58 (4) Section 53A-2-118.3 is repealed December 31, 2016.
59 (5) The State Instructional Materials Commission, created in Section 53A-14-101 , is
60 repealed July 1, [
61 (6) Subsections 53A-16-107 (3) and (4) are repealed December 31, 2016.
62 (7) Section 53A-16-107.1 is repealed December 31, 2016.
63 (8) Section 53A-17a-163 , Performance-based Compensation Pilot Program is repealed
64 July 1, 2011.
65 (9) Subsection 53C-3-203 (5), which provides for the distribution of money from the
66 Land Exchange Distribution Account to the Geological Survey for test wells, other hydrologic
67 studies, and air quality monitoring in the West Desert, is repealed July 1, 2020.
68 Section 4. Section 63I-1-261 is amended to read:

71 Section 5. Section 63I-1-263 is amended to read:
72 63I-1-263. Repeal dates, Titles 63 to 63M.
73 (1) Section 63A-4-204 , authorizing the Risk Management Fund to provide coverage to
74 any public school district which chooses to participate, is repealed July 1, 2016.
75 (2) Section 63A-5-603 , State Facility Energy Efficiency Fund, is repealed July 1, 2016.
76 (3) Section 63C-8-106 , Rural residency training program, is repealed July 1, 2015.
77 (4) Subsection 63G-6-502 (5)(b)(ii) authorizing certain transportation agencies to award
78 a contract for a design-build transportation project in certain circumstances, is repealed July 1,
79 2015.
80 (5) The Resource Development Coordinating Committee, created in Section
81 63J-4-501 , is repealed July 1, 2015.
82 (6) Title 63M, Chapter 1, Part 4, Enterprise Zone Act, is repealed July 1, 2018.
83 (7) (a) Title 63M, Chapter 1, Part 11, Recycling Market Development Zone Act, is
84 repealed July 1, 2020.
85 (b) Sections 59-7-610 and 59-10-1007 regarding tax credits for certain persons in
86 recycling market development zones, are repealed for taxable years beginning on or after
87 January 1, 2011.
88 (c) Notwithstanding Subsection (7)(b), a person may not claim a tax credit under
89 Section 59-7-610 or 59-10-1007 :
90 (i) for the purchase price of machinery or equipment described in Section 59-7-610 or
91 59-10-1007 , if the machinery or equipment is purchased on or after July 1, 2010; or
92 (ii) for an expenditure described in Subsection 59-7-610 (1)(b) or 59-10-1007 (1)(b), if
93 the expenditure is made on or after July 1, 2010.
94 (d) Notwithstanding Subsections (7)(b) and (c), a person may carry forward a tax credit
95 in accordance with Section 59-7-610 or 59-10-1007 if:
96 (i) the person is entitled to a tax credit under Section 59-7-610 or 59-10-1007 ; and
97 (ii) (A) for the purchase price of machinery or equipment described in Section
98 59-7-610 or 59-10-1007 , the machinery or equipment is purchased on or before June 30, 2010;
99 or
100 (B) for an expenditure described in Subsection 59-7-610 (1)(b) or 59-10-1007 (1)(b), the
101 expenditure is made on or before June 30, 2010.
