7 LONG TITLE
8 General Description:
9 This joint resolution authorizes the judicial department to remove district court
10 operations from the city of Orem.
11 Highlighted Provisions:
12 This resolution:
13 . pursuant to U.C.A. Subsection 78A-5-111 (2)(c), seeks legislative authority for the
14 judicial department to remove district court operations from the city of Orem.
15 Special Clauses:

18 Be it resolved by the Legislature of the state of Utah:
19 WHEREAS, the city of Orem has formed a justice court to hear and determine small
20 claims cases, infractions, and class B and class C misdemeanors;
21 WHEREAS, the city of Orem wants to use the district court space for its justice court
22 operations;
23 WHEREAS, the judicial department, in an effort to consolidate operations and save
24 resources, desires to remove its district court operations from the city of Orem;
25 WHEREAS, removal of district court operations from the city of Orem will leave a
26 district court in three municipalities to serve the citizens of Utah County; and
27 WHEREAS, Subsection 78A-5-111 (2)(c) requires that removal of a district court from

28 a municipality in which a circuit court formerly existed have legislative approval by joint
29 resolution:
30 NOW, THEREFORE, BE IT RESOLVED by the Legislature of the state of Utah that
31 the judicial department may remove district court operations from the city of Orem.
