COMMUNICATIONS DEVICE USAGE JOINT RESOLUTION

7 LONG TITLE
8 General Description:
9 This rules resolution amends the Joint Legislative Rules to establish procedures
10 regulating reimbursement for expenses incurred for use of communications devices.
11 Highlighted Provisions:
12 This resolution:
13 . provides that the presiding officer, the majority leader, and the minority leader of
14 each house may establish reimbursement polices and procedures for expenses
15 incurred for approved communications devices;
16 . requires the Legislative Expenses Oversight Committee to ensure that procedures
17 are established for the purpose of avoiding duplicate or improper reimbursements;
18 and
19 . permits a legislator to decline to receive a reimbursement or to receive a partial or
20 reduced reimbursement amount.

29 Be it resolved by the Legislature of the state of Utah:
30 Section 1. JR5-5-101 is enacted to read:
31 CHAPTER 5. COMMUNICATION DEVICE EXPENSES
32 JR5-5-101. Reimbursement for Communications Device Expenses.
33 (1) The presiding officer, the majority leader, and the minority leader of each house of
34 the Legislature may establish a policy governing reimbursement for expenses related to
35 communication devices, which policy shall include:
36 (a) the types of communication device expenses that will be reimbursed to legislators;
37 and
38 (b) the process for reimbursement of communication device expenses.
39 (2) A legislator may, pursuant to a policy adopted under Subsection (1), be reimbursed
40 for use of a communications device that is:
41 (a) owned by the legislator; and
42 (b) used by the legislator in the legislator's capacity as an employee of the Legislature.
43 Section 2. JR5-5-102 is enacted to read:
44 JR5-5-102. Verification -- Procedures.
45 (1) Each legislator shall provide supporting documentation for each cost or expense for
46 which a legislator seeks reimbursement under this chapter.
47 (2) The Legislative Expenses Oversight Committee shall ensure that procedures are
48 established for the purpose of avoiding duplicate or improper reimbursements.
49 Section 3. JR5-5-103 is enacted to read:
50 JR5-5-103. Declining Reimbursement and Reduced Reimbursement.
51 (1) A legislator may decline to request or receive reimbursement for any expense that is
52 reimbursable under this chapter.
53 (2) A legislator may request and receive a partial or reduced reimbursement for any
54 expense that is reimbursable under this chapter.
