DISPOSAL OF UNUSED PRESCRIPTION DRUGS

7 LONG TITLE
8 General Description:
9 This bill amends the Pharmacy Practice Act to require the
9a H. [ pharmacy board ] division .H to adopt
10 rules regarding the disposal of unused prescription drugs in accordance with federal
11 laws and regulations.
12 Highlighted Provisions:
13 This bill:
14 . enacts a requirement that the H. [ pharmacy board ] division .H allow a pharmacy to
14a take back unused
15 prescription drugs if the federal rules permit a pharmacy take back program; and
16 . requires the H. [ pharmacy board ] division .H to enact administrative rules regarding
16a unused drug
17 take back programs once federal rules related to drug take back programs are
18 published.

27 Be it enacted by the Legislature of the state of Utah:

28 Section 1. Section 58-17b-622 is enacted to read:
29 58-17b-622. Disposal of unused prescription drugs.
30 (1) A pharmacy may accept unused prescription drugs for disposal in accordance with
31 administrative rules adopted by the H. [ board ] division .H .
32 (2) The H. [ board ] division .H shall adopt administrative rules regarding a pharmacy
32a accepting unused
33 prescription drugs for disposal as permitted by federal law and regulation relating to the
34 disposal of unused prescription drugs.
