PROVISIONS REGARDING SCHOOL SUPPLIES

             7      LONG TITLE
             8      General Description:
             9          This bill modifies provisions regarding school supplies for elementary school students.
             10      Highlighted Provisions:
             11          This bill:
             12          .    allows an elementary school or elementary school teacher to provide to a student's
             13      parent or guardian a suggested list of supplies for use during the regular school day;
             14      and
             15          .    requires that a suggested list of supplies include specified language explaining that:
             16              .    the list is compiled solely to provide information to parents and guardians who
             17      wish to voluntarily furnish supplies for student use; and
             18              .    equivalent supplies will be furnished by the school to all students free of charge
             19      as necessary.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 53A-12-102 is amended to read:
             30           53A-12-102. State policy on student fees, deposits, or other charges.
             31          (1) A fee, deposit, or other charge may not be made, or any expenditure required of a
             32      student or the student's parent or guardian, as a condition for student participation in an
             33      activity, class, or program provided, sponsored, or supported by or through a public school or
             34      school district, unless authorized by the local school board or charter school governing board
             35      under rules adopted by the State Board of Education.
             36          (2) (a) A fee, deposit, charge, or expenditure may not be required for elementary school
             37      activities which are part of the regular school day or for [materials] supplies used during the
             38      regular school day.
             39          (b) An elementary school or elementary school teacher may compile and provide to a
             40      student's parent or guardian a suggested list of supplies for use during the regular school day so
             41      that a parent or guardian may furnish on a voluntary basis those supplies for student use.
             42          (c) A list provided to a student's parent or guardian pursuant to Subsection (2)(b) must
             43      include and be preceded by the following language:
             44          "NOTICE: THE ITEMS ON THIS LIST ARE OPTIONAL. NO ELEMENTARY
             45      SCHOOL STUDENT MAY BE REQUIRED TO BRING ANY OF THESE SUPPLIES TO
             46      SCHOOL. THIS LIST IS COMPILED SOLELY TO PROVIDE INFORMATION TO
             47      PARENTS OR GUARDIANS WHO WISH TO VOLUNTARILY FURNISH SUPPLIES FOR
             48      STUDENT USE. EQUIVALENT SUPPLIES WILL BE FURNISHED BY THE SCHOOL TO
             49      ALL STUDENTS FREE OF CHARGE AS NECESSARY."
