             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Transportation Code by amending provisions relating to the
             10      disposition of a portion of realigned highways.
             11      Highlighted Provisions:
             12          This bill:
             13          .    provides that when a state highway is realigned, the department may dispose of the
             14      former portion of the highway by complying with certain disposal of real property
             15      provisions if the former highway was purchased in fee; and
             16          .    makes technical changes.
             17      Money Appropriated in this Bill:
             18          None

             22      AMENDS:
             23          72-4-104, as renumbered and amended by Laws of Utah 1998, Chapter 270

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 72-4-104 is amended to read:
             27           72-4-104. Disposition of portion of highways realigned.
             28          (1) The department may make changes in the alignment of state highways to provide
             29      for greater highway safety or more economical highway operation and maintenance.


             30          (2) When a state highway is realigned, the former portion of it may be:
             31          (a) returned or relinquished to the county or municipality in which it is situated to be
             32      maintained as a highway; [or]
             33          (b) abandoned by the department if it no longer serves the purpose of a highway[.]; or
             34          (c) disposed of in accordance with Section 72-5-111 if the former portion was
             35      purchased in fee.
