             7      LONG TITLE
             8      General Description:
             9          This bill amends Title 73, Chapter 18, State Boating Act, by clarifying the scope of
             10      rulemaking authority of the Board of Parks and Recreation.
             11      Highlighted Provisions:
             12          This bill:
             13          .    permits a person to wear a non-Coast Guard approved personal floatation device if
             14      the person is:
             15              .    engaged in barefoot water skiing;
             16              .    participating in an American Water Ski Association regulation competition;
             17              .    a performer participating in a professional exhibition or other tournament; or
             18              .    practicing for a competition, exhibition, or other tournament;
             19          .    states that an observer and flag are not required during water skiing if the vessel is:
             20              .    equipped with a wide angle mirror with a surface area of at least 48 square
             21      inches; and
             22              .    being operated by a person who is at least 18 years old; and
             23          .    makes technical changes.

             33      Be it enacted by the Legislature of the state of Utah:
             34          Section 1. Section 73-18-15 is amended to read:
             35           73-18-15. Board to adopt rules concerning water skiing and aquaplane riding
             36      and use of other devices towed behind a vessel.
             37          The board shall adopt rules for the regulation and safety of water skiing and aquaplane
             38      riding, and the use of other devices [which] that are towed behind a vessel pursuant to this
             39      section and in accordance with Section 73-18-16 .
             40          Section 2. Section 73-18-16 is amended to read:
             41           73-18-16. Regattas, races, exhibitions -- Rules.
             42          (1) The division may authorize the holding of regattas, motorboat or other boat races,
             43      marine parades, tournaments, or exhibitions on any waters of this state.
             44          (2) The board may adopt rules concerning the safety of vessels and persons, either as
             45      observers or participants[.], that do not conflict with the provisions of Subsections (3) and (4).
             46          (3) A person may elect, at the person's own risk, to wear a non-Coast Guard approved
             47      personal floatation device if the person is on an American Water Ski Association regulation
             48      tournament slalom course and is:
             49          (a) engaged in barefoot water skiing;
             50          (b) water skiing in an American Water Ski Association regulation competition;
             51          (c) a performer participating in a professional exhibition or other tournament; or
             52          (d) practicing for an event described in Subsection (3)(b) or (c).
             53          (4) If a person is water skiing in an American Water Ski Association regulation
             54      tournament slalom course, an observer and flag are not required if the vessel is:
             55          (a) equipped with a wide angle mirror with a viewing surface of at least 48 square
             56      inches; and
             57          (b) operated by a person who is at least 18 years of age.
