             8      General Description:
             9          This bill enacts language related to the computation of time in statutory construction.
             10      Highlighted Provisions:
             11          This bill:
             12          .    enacts language related to the computation of time in statutory construction; and
             13          .    makes technical corrections.

             23      Be it enacted by the Legislature of the state of Utah:
             24          Section 1. Section 68-3-7 is amended to read:
             25           68-3-7. Time, how computed.
             26          [The] (1) A person shall compute the period of time [in which any act] provided by law
             27      [is to be done is computed] to perform an act by:


             28          (a) excluding the first day; and
             29          (b) except as provided in Subsection (2), including the last[, unless] day.
             30          (2) If the last day is [a holiday, and then it also is excluded.] a legal holiday, a
             31      Saturday, or a Sunday, then a person shall:
             32          (a) exclude the day described in Subsection (2) from the time computation described in
             33      Subsection (1); and
             34          (b) compute the period of time to include the end of the next day that is not a legal
             35      holiday, a Saturday, or a Sunday.
             36          Section 2. Section 68-3-8 is amended to read:
             37           68-3-8. When a day appointed is a holiday.
             38          Whenever any act of a secular nature, other than a work of necessity or mercy, is
             39      appointed by law or contract to be performed upon a particular day, which day falls upon a
             40      legal holiday, such act may be performed upon the next succeeding business day with the same
             41      effect as if it had been performed upon the day appointed.
