House Committee Amendments

Representative Stephen E. Sandstrom proposes the following amendments:

1.    Page 1, Line 12 :    

             12          .    defines Internet gambling;
{   and   }


2.    Page 1, Line 14 :    

             14      gambling
  ;

    . provides that any person who knowingly transmits, receives, or relays any form of Internet or online gambling into or within this state is guilty of a class A misdemeanor; and
    . requires that the governor advise the federal government of this state's choice to opt out of Internet gambling if any federal law authorizes Internet gambling  
.


3.    Page 1, Line 18 :    

             18          
{   None   }        This bill takes effect on July 1, 2012.      


4.    Page 3, Line 85 :    

             85      misdemeanor.
  (3) A person is guilty of a class A misdemeanor who:

(a) knowingly transmits, receives, or relays any form of Internet or online gambling into or within this state; or
(b) promotes, offers, or provides Internet gambling in this state.  

  (4) If any federal law is enacted that authorizes Internet gambling in the states and the federal law provides that individual states may opt out of allowing Internet gambling by the process of the governor of the state advising the federal regulatory authority of the state's choice to opt out, the governor of this state shall inform the regulatory authority in compliance with the opt-out provisions of the federal legislation.

(5) Whether or not any federal law is enacted that authorizes Internet gambling in the states, this section acts as this state's prohibition of any gambling, including Internet gambling, in this state.  


  Section 3. Effective date.

This bill takes effect on July 1, 2012.
