             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Utah Criminal Code regarding prostitution.
             10      Highlighted Provisions:
             11          This bill:
             12          .    provides that a second or subsequent offense of patronizing a prostitute as a
             13      violation of state law or a local ordinance is a class A misdemeanor.
             14      Money Appropriated in this Bill:

             20          76-10-1303, as last amended by Laws of Utah 1993, Chapter 179

             22      Be it enacted by the Legislature of the state of Utah:
             23          Section 1. Section 76-10-1303 is amended to read:
             24           76-10-1303. Patronizing a prostitute.
             25          (1) A person is guilty of patronizing a prostitute when:
             26          (a) [he] the person pays or offers or agrees to pay another person a fee for the purpose
             27      of engaging in an act of sexual activity; or


             28          (b) [he] the person enters or remains in a house of prostitution for the purpose of
             29      engaging in sexual activity.
             30          (2) Patronizing a prostitute is a class B misdemeanor, except as provided in Subsection
             31      (3) and in Section 76-10-1309 .
             32          (3) A violation of this section that is preceded by a conviction under this section or a
             33      conviction under local ordinance adopted under Section 76-10-1307 is a class A misdemeanor.
