8 LONG TITLE
9 General Description:
10 This bill amends provisions of Title 53, Chapter 9, Private Investigator Regulation Act
11 to provide for a limited-use license for a person to provide private investigator or
12 private detective services to a legislative body under certain circumstances.
13 Highlighted Provisions:
14 This bill:
15 . defines terms;
16 . provides for the issuance of a limited-use license to provide private investigator or
17 private detective services to:
18 . a special investigative committee; or
19 . a legislative body for a purpose relating to impeachment;
20 . describes the qualifications for, and the scope of, a limited-use license;
21 . describes the procedure for granting a limited-use license; and
22 . provides for the expiration of a limited-use license.

26 This bill provides an immediate effective date.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 53-9-121 is enacted to read:
33 53-9-121. Limited-use license.
34 (1) As used in this section:
35 (a) "Legislative body" means:
36 (i) the Legislature;
37 (ii) the Utah House of Representatives;
38 (iii) the Utah Senate;
39 (iv) a special investigative committee; or
40 (v) a staff office of the Legislature.
41 (b) "Special investigative committee" is as defined in Subsection 36-12-9 (1).
42 (2) Notwithstanding any provision of this chapter, a person is qualified to receive a
43 limited-use license if the person:
44 (a) is licensed, in good standing, by another state, district, or territory of the United
45 States to provide the services of a private investigator or private detective; and
46 (b) is retained by a legislative body to provide the services of a private investigator or
47 private detective for:
48 (i) a special investigative committee; or
49 (ii) a purpose relating to impeachment.
50 (3) A person holding a limited-use license may only provide the services described in
51 Subsection (2)(b).
52 (4) The bureau shall issue a limited-use license to a person within five days after the
53 day on which the bureau receives notice from a legislative body that:
54 (a) the person meets the qualifications described in Subsection (2)(a); and
55 (b) the legislative body has retained the person to provide the services described in
56 Subsection (2)(b).
57 (5) The bureau may not:
58 (a) impose a qualification for the receipt of a limited-use license other than the
59 qualifications described in Subsection (2)(a); or
60 (b) charge a fee to issue a limited-use license.
61 (6) A limited-use license expires when the person to whom it is issued is no longer
62 retained by a legislative body to provide a service described in Subsection (2)(b).
63 Section 2. Effective date.
64 If approved by two-thirds of all the members elected to each house, this bill takes effect
65 upon approval by the governor, or the day following the constitutional time limit of Utah
66 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
67 the date of veto override.
