             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Budgetary Procedures Act by amending provisions relating to
             10      state employee furloughs due to reductions in federal funding.
             11      Highlighted Provisions:
             12          This bill:
             13          .    defines furlough;
             14          .    authorizes certain state agencies to use existing resources from funds appropriated
             15      to the agency to pay fixed cost benefits and holiday leave benefits for state
             16      employees furloughed as a result of a reduction or loss in federal funding;
             17          .    repeals the authorization on December 1, 2013; and
             18          .    makes technical corrections.
             19      Money Appropriated in this Bill:
             20          None
             21      Other Special Clauses:
             22          This bill provides an immediate effective date.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 63I-2-263 is amended to read:
             30           63I-2-263. Repeal dates, Title 63A to Title 63M.
             31          (1) Section 63A-1-115 is repealed on July 1, 2014.
             32          (2) Subsection 63J-1-218 (3) is repealed on December 1, 2013.
             33          [(2)] (3) Subsection 63M-1-903 (1)(d) is repealed on July 1, 2015.
             34          Section 2. Section 63J-1-218 is amended to read:
             35           63J-1-218. Reduction in federal funds -- Agencies to reduce budgets.
             36          (1) In any fiscal year in which federal grants to be received by state agencies,
             37      departments, divisions, or institutions are reduced below the level estimated in the
             38      appropriations acts for that year, the programs supported by those grants must be reduced
             39      commensurate with the amount of the federal reduction unless the Legislature appropriates
             40      state funds to offset the loss in federal funding.
             41          (2) This program modification shall be reported to the Legislature through the
             42      Executive Appropriations Committee and the Office of the Legislative Fiscal Analyst.
             43          (3) (a) As used in this Subsection (3), "furlough" means a temporary leave of absence
             44      from duty without pay for budgetary reasons.
             45          (b) Notwithstanding Subsection (1), the following state agencies may use existing
             46      resources from funds previously appropriated to the agency to pay fixed cost benefits and
             47      holiday leave benefits for state employees furloughed as a result of a reduction or loss in
             48      federal funding:
             49          (i) the Utah National Guard;
             50          (ii) the Utah State Office of Rehabilitation;
             51          (iii) the Utah Labor Commission; and
             52          (iv) the Division of Family Health and Preparedness within the Utah Department of
             53      Health.
             54          Section 3. Effective date.
             55          If approved by two-thirds of all the members elected to each house, this bill takes effect
             56      upon approval by the governor, or the day following the constitutional time limit of Utah
             57      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             58      the date of veto override.
