             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 53A-1-414 is enacted to read:
             26          53A-1-414. Definitions.
             27          For purposes of Sections 53A-1-414 and 53A-1-415 :


             28          (1) (a) "Front-line teacher" means a licensed teacher who has an assignment to teach a
             29      kindergarten, elementary, secondary, or special education course.
             30          (b) "Front-line teacher" does not include a prekindergarten teacher, a school-based
             31      specialist, or a classroom aide.
             32          (2) "LEA compensation percentage" means the amount of money from an LEA's
             33      general fund expended for front-line teachers, including benefits, divided by the LEA's total
             34      general fund, excluding money expended for:
             35          (a) capital outlay or debt service;
             36          (b) pupil transportation; and
             37          (c) custodial and maintenance expenses.
             38          (3) "LEA front-line teacher percentage" means the number of full-time equivalent
             39      front-line teachers in an LEA divided by the total number of full-time equivalent employees in
             40      an LEA, excluding employees associated with pupil transportation, capital facilities
             41      construction, and custodial and maintenance.
             42          (4) "LEA percentage" means the average of an LEA's compensation percentage and the
             43      LEA's front-line teacher percentage.
             44          (5) "Local education agency" or "LEA" means a school district or charter school.
             45          (6) "Statewide compensation percentage" means the amount of money from all LEAs'
             46      general funds expended for front-line teachers, including benefits, divided by all LEAs' total
             47      general funds, excluding money expended for:
             48          (a) capital outlay or debt service;
             49          (b) pupil transportation; and
             50          (c) custodial and maintenance.
             51          (7) "Statewide front-line teacher percentage" means the number of full-time equivalent
             52      front-line teachers in all LEAs divided by the total number of full-time equivalent employees in
             53      all LEAs, excluding employees associated with pupil transportation, capital facilities
             54      construction, and custodial and maintenance.
             55          (8) "Statewide percentage" means the average of the statewide compensation
             56      percentage and the statewide front-line teacher percentage.
             57          Section 2. Section 53A-1-415 is enacted to read:
             58          53A-1-415. Reporting requirements and data collection related to front-line


             59      teachers -- Audit procedures.
             60          (1) (a) H. [ An LEA ] The State Board of Education .H shall report all information as
             60a      required in this section.
             61          (b) The information reported in accordance with this section shall be from the previous
             62      school year.
             63          (2) (a) An LEA shall report all necessary data to the State Board of Education for
             64      purposes of calculating the percentages defined in Section 53A-1-414 .
             65           H. [ (b) An LEA shall report the following data to the State Board of Education:
             66          (i) the LEA's total number of FTE front-line teachers; and
             67          (ii) the LEA's average class size for:
             68          (A) elementary school;
             69          (B) middle or junior high school; and
             70          (C) high school.
             71          (c)

The State Board of Education shall make rules specifying how an LEA
             71a      shall report
             72      the required data for purposes of this Subsection (2) ensuring the data is comparable.
             73          (3) By the November 2014 interim meeting, the State Board of Education shall report
             74      to the Education Interim Committee:
             75          (a) the statewide and LEA percentages defined in Section 53A-1-414 ;
             76          (b) all underlying data submitted by the LEAs described in Subsection (2); and
             77          (c) the average daily membership of each LEA, as reported in the most recent state
             78      superintendent's report.
             78a           H. (4) The State Board of Education shall make the information described in
             78b      Subsection (3) available on the Internet. .H
