             8      General Description:
             9          This bill modifies the Criminal Code regarding the offense of bigamy.
             10      Highlighted Provisions:
             11          This bill:
             12          .    removes cohabitation with another person as an element of the offense of bigamy.

             21      Be it enacted by the Legislature of the state of Utah:
             22          Section 1. Section 76-7-101 is amended to read:
             23           76-7-101. Bigamy -- Defense.
             24          (1) A person is guilty of bigamy when, knowing he or she has a husband or wife or
             25      knowing the other person has a husband or wife, the person purports to marry another person
             26      [or cohabits with another person].
             27          (2) Bigamy is a third degree felony [of the third degree].


             28          (3) It [shall be] is a defense to a charge of bigamy that the accused reasonably believed
             29      he or she and the other person were legally eligible to marry or remarry.
