             8      General Description:
             9          This bill addresses the admission of certain students to an institution of higher
             10      education.
             11      Highlighted Provisions:
             12          This bill:
             13          .    defines terms; and
             14          .    prohibits the use of certain academic performance criteria in considering the
             15      admission of certain combat veterans or children of combat veterans to an
             16      institution of higher education.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 53B-16-108 is enacted to read:
             27          53B-16-108. Admission of certain combat veterans and children of combat


             28      veterans to an institution of higher education.
             29          (1) As used in this section:
             30          (a) "Academic performance" means:
             31          (i) high school grade point average;
             32          (ii) cumulative grade point average in college or university courses;
             33          (iii) high school percentile rank;
             34          (iv) high school, college, or university course grades; or
             35          (v) standardized test scores.
             36          (b) "Combat veteran" means a person who has served in the armed forces and was
             37      deployed to a combat zone designated by executive order of the president of the United States.
             38          (c) "Eligible applicant" means an applicant for admission to an institution of higher
             39      education who is:
             40          (i) a combat veteran who, by the first day of classes for the term the applicant seeks to
             41      attend, will be a resident of Utah for a continuous five-year period; or
             42          (ii) a biological or adopted child of an individual described in Subsection (1)(c)(i).
             43          (d) "Freshman" means a student who has earned fewer than 30 semester credits or 45
             44      quarter credits of college or university course work.
             45          (e) "Institution of higher education" means an entity listed in Section 53B-2-101 .
             46          (2) An institution of higher education may not consider an eligible applicant's academic
             47      performance in determining whether the eligible applicant qualifies for admission to the
             48      institution as a freshman.
             49          (3) An institution of higher education may require an eligible applicant to have a high
             50      school diploma or a General Educational Development (GED) diploma.
