2:15         2.     Admin istrati ve Enforc ement of Civil Fines and Penalti es    
                    Under its police power, the state has authorit y to establish civil fines and penalties for violation s of its statutory provisio ns. The legislatu re possesse s broad discretio n in prescribi ng penalties for conduct it deems punisha ble. The committ ee will hear testimon y concerni ng a central panel of administ rative law judges.

3:00         3.    Immu nity for Volun teers
                            Five differe nt Utah statute s attemp t to provid e immun ity for volunt eers under certain circum stance s. The federal govern ment recentl y passed a volunt eer protect ion act which preem pts some state immun ity statute s. Utah needs

to review its immuni ty statute s and determ ine whethe r or not its current statute s provid e sufficie nt immuni ty for people who volunte er.
                  
4:15         4.     Evaluation Criteria for the Selection of Judicial Nominees
                            Article VIII, Section 8 of the Utah Constit ution provid es that the Legislat ure shall by statute provide for the nominati ng commiss ions' composit ion and procedu res. To date, the Judicial Council has provided for nominati ng commiss ions' procedu res. These procedu res have been not been drafted or reviewed by the Legislat ure as required by the Utah Constitu tion. The commi ttee should review these proced ures and be prepar ed to discus s whethe r nomin ating proced ures should be contai ned in statute .
