1.    Call to Order - Chair Chard called the meeting to order at 1:34 p.m.
    
     MOTION: Mr. Jerry Peterson moved to approve the September 25 and October 16, 1997 minutes. The motion passed unanimously with Sen. Howell, Mr. Mecham, Mr. Packer, and Mr. G. Peterson absent for the vote.

2.     1998-99 (FY99) Information Technology Budget Presentation _ Jerry Peterson spoke on behalf of the Office of Public Education. Vicky Dahn, Office of Public Education, distributed a handout titled, "Public Education Technology Funding Requests." She explained the contents of the handout, including funding histories and funding requests for EDNET, UtahLink, and Educational Technology Initiative (ETI). The report also signified coordination with other state agencies.

    Gordon Peterson, State Chief Information Officer, distributed a handout titled, "IT- Related Budget Requests in the Executive Branch," and he gave a slide presentation explaining the requests. Alan Carlsen, CIO staff, also discussed budget requests of the Executive Branch.
    Mark Allred, Utah Legislature, distributed a handout titled, "Legislative Technology Initiatives." He explained the information as written in the handout and answered questions.

     MOTION: Rep. Stephens moved that staff draft a letter to leadership encouraging them to provide legislators with year-round Internet access and that, when possible, staff should send information electronically. The motion passed unanimously. Sen. Howell was absent for the vote.

    Dr. Mike Petersen, Board of Regents, distributed a report titled, "USHE Technology & Distance Education Initiative Revised Funding Strategy and Three Year funding Proposal - August, 1997." The report also included additional requests anticipated for 1998/99, and a 1996/1997 progress report of the Utah System of Higher Education (USHE) technology and distance education initiative. He discussed the report with the committee.

     MOTION: Ms. Longsworth moved that the Information Technology Commission support the Utah System of Higher Education and its effort to expand its capacity to educate Information Technology students and send a letter to: (1) Joint Liaison Committee for Public and Higher Education; (2) Presidents of the nine Utah institutions of higher education; (3) Applied Technology Centers; (4) Executive Appropriations Committee; and (5) legislative leadership advising them that the Commission recognizes a shortage of information technology professionals within the state which is affecting state government, local government, and the industry as a whole, and that the Commission encourages Higher Education and the ATC's to work to increase their capacity to educate students to fill the need. The motion passed unanimously with Sen. Howell absent for the vote.

    Rolen Yoshinaga, Office of Court Administrator, distributed a handout titled, "Request for Change in FY 1999 Budget." He explained the budget requests as outlined and briefly spoke about recommendations made by the Information Automation and Records Committee. He also distributed a handout titled, "Program Abstract," identifying the Juvenile Court automation re-engineering process.

    Mr. Yoshinaga also spoke about the Electronic Law Project which is an effort by members of the bar to move the practice of law into using electronic processes.

    Chair Chard asked Mr. Yoshinaga to bring priorities of how the budget will be spread to the appropriations subcommittee meetings during the 1998 General Session.


3.    Privacy: Draft Legislation Review _

Privacy Task Force

    Tani Pack Downing, Associate General Counsel, Office of Legislative Research and General Counsel, discussed draft legislation titled, "Privacy Task Force." Rep. Stephens was concerned about the duties of the task force. Chair Chard suggested tabling the "Privacy Task Force" draft bill and to send suggestions for study issues of the task force to Ms. Downing.

    Chair chard asked for a show of hands indicating those in support of a task force and those opposed. Of the twelve members present, six were in favor and six opposed the creation of a task force.

Electronic Posting of Notices

    Ms. Downing briefed the committee on draft legislation titled "Electronic Posting of Notices." Chair Chard suggested that a date of December 31, 1998, be inserted on line 24.

     MOTION: Ms. Longsworth moved: on page 1, line 24, after "(3)" delete the rest of the line. The motion passed with Mr. Packer voting in opposition to the motion. Sen. Howell, Rep. Stephens, Mr. Capps, and Dr. Petersen were absent for the vote.

     MOTION: Rep. Goodfellow moved to approve draft legislation, "Electronic Posting of Notices ," as amended. The motion passed unanimously with Sen. Howell, Rep. Stephens, Mr. Capps, and Dr. Petersen absent for the vote.

Resolution Encouraging Development of Electronic Voting

    Ms. Downing also discussed draft legislation titled, "Resolution Encouraging Development of Electronic Voting." Kelleen Potter, Lt. Governor's Office, asked for clarification as to the expectations of her office pertaining to electronic voting. She said her office is considering Weber County as a pilot site for Internet voting, by military voters only .
                                                
     MOTION: Ms. Longsworth moved to delete lines 18 and 19 on draft legislation, "Resolution Encouraging Development of Electronic Voting ."

     SUBSTITUTE MOTION: Rep. Goodfellow moved to delay further voting on the draft legislation, "Resolution Encouraging Development of Electronic Voting, " until the chairs set a new date to discuss the bill. The motion passed unanimously with Sen. Howell, Rep. Stephens, Mr. Capps, Dr. Petersen, and J. Peterson were absent for the vote.

    Mr. G. Peterson said that "Digital Signature Day" will be held at 11:30 a.m. in the Governor's Board Room on Wednesday, November 19, and invited members of the Information Technology Commission to attend.

    Ms. Downing handed out several articles pertaining to privacy issues titled, "Privacy Trumps Access, and It Ain't Cheap," "HHC Calls for National Law to Protect Health Info," and "Conference Report -- Telecommunications -- Internet."
    
4.    Committee Business _ Chair Chard reminded the committee that the November 17 meeting will begin at 1:00 p.m.

    MOTION: Ms. Gibbs moved to adjourn the meeting at 4:25 p.m. The motion passed unanimously with Sen. Howell, Rep. Stephens, Mr. Capps, and Dr. Petersen absent for the vote.
