2:05 p.m. 2. Accessible Housing for Persons With a Disability

In September, the Committee reviewed draft legislation prepared to encourage the development of housing accessible to persons with a mobility impairment. The Committee will review a revised draft of the bill.





2:15 p.m. 3. Legislative Proposals for 2003 General Session

The Committee will review proposed legislation related to health and human services.





2:40 p.m. 4. Repeal of FACT (Families, Agencies, and Communities Together for Children and Youth at Risk) Funding - Report by Fiscal Analyst

"It is the intent of the Legislature that the Fiscal Analyst Office shall continue with their proposed study of the FACT. Program despite the elimination of this program via FY 2003 budget cuts. Along with the outlined study already proposed, the Fiscal Analyst Office shall include an evaluation of what structures, if any, continue despite the loss of funding. The Fiscal Analyst Office shall also compile a report of the impact of the loss of FACT. funding on families already receiving services, and the impact on the collaboration and coordination of services across the various agencies involved." (S.B. 5009, 2002 Fifth Special Session)



3:00 p.m. 5. Funding of State and County Health and Human Services Legislative Task Force - Report

"(1) The committee shall review and make recommendations on the following issues:

(a) the role and responsibility of state government and local governments for funding and operating health and human services programs within the state; and

(b) the allocation of funding for health and human services programs to local governments.

(2) A final report, including any proposed legislation shall be presented to the Health and Human Services Interim Committee before November 30, 2002." (H.B. 251, 2002 General Session)





3:30 p.m. 6. Task Force on Involuntary Commitment of the Mentally Ill - Report

"(1) The committee shall review and make recommendations on the following issues:

(a) admissibility of evidence at hearings of historical information concerning patterns of treatment compliance and decompensation;

(b) criteria for determining the need for involuntary commitment;

(c) inclusion of involuntary medication decisions in conjunction with involuntary commitment processes; and

(d) the need for community based mental health services.

(2) A final report, including any proposed legislation shall be presented to the Health and Human Services Interim Committee before November 30, 2002." (S.B. 77, 2002 General Session)





3:50 p.m. 7. Access to Health Care and Coverage Task Force - Report

"(1) The task force shall review and make recommendations on the following:

(a) options for improving access to health care coverage and access to primary care for Utah's uninsured population that:

(i) focus attention on those who are most in need;

(ii) strike an appropriate and effective balance between private and public sector approaches including employer, employee, and public sector partnerships; and

(iii) build on existing systems of proven effectiveness;

(b) the implementation and design of the Department of Health's "Covering the Uninsured 2000" grant process and recommendations; and

(c) the state's progress in implementing Medicaid waivers and health care access programs.

(2) (a) In reviewing and making its recommendations, the task force shall:

(i) receive input from stake holders in the health care system;

(ii) consider the costs and potential savings associated with each option it recommends under Subsection (1)(a); and

(iii) consider the effect of each option recommended under Subsection (1)(a) on cost-shifting, uncompensated care, and existing programs and systems.

(b) A final report, including any proposed legislation, shall be presented to the Health and Human Services Interim Committee before November 30, 2002." (S.B. 33, 2002 General Session)





4:05 p.m. 8. Child Welfare Legislative Oversight Panel - Report

"(4) The panel shall:

(a) examine and observe the process and execution of laws governing the child welfare system by the executive branch and the judicial branch;...

(f) study and recommend proposed changes to laws governing the child welfare system;...

(j) annually report its findings and recommendations to the president of the Senate, the speaker of the House of Representatives, the Health and Human Services Interim Committee, and the Judiciary Interim Committee." (§62A-4a-207)





4:20 p.m. 9. Medicaid 1115 Primary Care Network Waiver - Follow-up Report

"(3) the commissioner as part of the requirements of Subsection 31A-2-201(7), and the executive director of the Department of Health shall report to the Health and Human Services Interim Committee prior to November 15 of each year concerning:

(a) the number of lives covered under any policy offered under the provisions of this section or under the Medicaid waiver described in Subsection (1);

(b) the claims experienced under the policies or Medicaid programs described in Subsection (3)(a);

(c) any cost shifting to the private sector for care not covered under the programs or policies described in Subsection (3)(a); and

(d) efforts or agreements between the Department of Health, the commissioner, insurers regulated under this chapter, and health care providers regarding combining publicly funded coverage with private, employer-based coverage to increase benefits and health care coverage." (§31A-22-633)



4:30 p.m. 10. Pharmaceuticals - Report by Department of Health Advisory Committee

"It is the intent of the Legislature that the Department of Health convene an ad hoc advisory committee by July 1, 2002 to advise the Legislature regarding options to improve access to pharmaceuticals for senior citizens, people with disabilities, Medicaid recipients, and the uninsured. The committee should also study and advise on methods to improve state financing of pharmaceutical coverage and purchasing to include a Medicaid waiver or demonstration project. The advisory committee shall be composed of representatives from the senior citizen, disabled, and low income communities; health care providers, the pharmaceutical industry, members of the business community, the department and the division. The executive director shall report progress to the Health and Human Services interim committee and the Health and Human Services Appropriations subcommittee no later than November 30, 2002 and shall recommend options for possible legislation, section 1115 waiver, and /or demonstration project by June 30, 2003." (S.B. 1, 2002 General Session)
